Reason for Recommended Action/Background
This item was continued from the October 8, 2019, Board meeting at the request of District 5.  This item was continued for a second time at the October 22, 2019, Board meeting. On October 25, 2019, Granite submitted a "Notice of Demolition" to County staff (see Attachment D) indicating that the barn will be removed on or about November 6, 2019.

Discussions between Granite Construction and District 5 remain ongoing.  Staff will provide a verbal update to the Board at the November 5, 2019 Board meeting. 

Summary of Requested Action
In 2002, Granite Construction and the County modified the Development Agreement (Development Agreement No. 96-289) for the Granite Capay mining facility (ZF#2001-096) to include that salvageable lumber from an existing 14,000 square foot barn (commonly referred to as the "Stephen's Barn") would be donated to the County for use in future construction of recreation features along Cache Creek. A location map of the barn is provided as Attachment C to this staff report. 

Granite is preparing to move into its next phase of their approved mining plan and the barn must be dismantled.  Granite approached the County earlier this year to begin the planning process for the dismantling of the barn.  Among other things, Granite needed to know how much lumber the County wanted and where it would be transported to for storage until its use. 

Granite and the County met at the barn site with various wood salvage and construction experts (consultants to both the County and Granite) to confer on lumber dimensions and potential future uses of the lumber.  Through this process it was discovered that a) the wood wasn't as old (i.e. valuable) as previously thought; b) the wood's condition wasn't as well preserved as previously thought; and c) the amount of salvageable lumber was much lower than previously thought.  

In light of the poor condition and reduced amount of salvageable lumber, staff proposed that Granite donate funds equal to the cash value of the lumber in lieu of dismantling the barn and donating the salvageable lumber.  The funds, which amount to a total of $20,043.73, are proposed to be used for improvements to Capay Open Space Park by way of additional shade structures and other minor improvements. 

Approval of the MOU will memorialize the cash donation in lieu of the barn lumber.  A formal amendment to the Development Agreement (Development Agreement No. 96-289) to modify the condition of approval will come to the Board at a future date, in conjunction with several modifications to Granite's mining operations that are pending review by the Planning Division. 

Recommended Action
Staff recommends that the Board approve the Memorandum of Understanding (Attachment A) and adopt a budget resolution (Attachment B) increasing the Cache Creek Resources Management Plan budget by $20,044.
