Recommended Action
  1. Adopt the attached Resolution of Acceptance of Parcel Map No. 5166 (Attachment B);
     
  2. Instruct the Clerk of the Board of Supervisors to verify that the Tax Collector has signed the map; and
     
  3. Authorize the Clerk of the Board of Supervisors to sign and transmit Parcel Map No. 5166 (Attachment C) to the County Clerk-Recorder for filing.

Reason for Recommended Action/Background
On May 9, 2019, the Planning Commission approved a Tentative Parcel Map (TPM) request to divide an existing 156.7-acre agricultural parcel into two parcels to separate agricultural operations and areas encumbered by a conservation easement from an existing pistachio orchard, resulting in one 43-acre orchard parcel (“Parcel 1”) and one 113-acre parcel planted in row crops (“Parcel 2”). Approximately 110 acres of the proposed 113-acre parcel are encumbered by a Yolo Land Trust conservation easement to provide Swainson’s Hawk foraging habitat.

The purpose of the Parcel Map is to enhance existing and future agricultural operations at the site, the division will allow for each of the resultant parcels to be managed and owned separate from one another. The defining characteristic of Yolo County is its agriculture and open spaces. The project site actively produces multiple crops while providing habitat value to the natural community. Separating the acreage planted in row crops and encumbered by the conservation easement from the orchard acreage will better facilitate future agricultural operations by creating one parcel that is encumbered by the Yolo Land Trust 'Willow Slough' conservation easement, that will forever be planted in crops that are compatible with Swainson's Hawk foraging habitat, and a separate parcel of unencumbered acreage, that can be owned and managed separate from the other resultant parcel; the proposal does not include any development.

While Yolo County generally discourages the division of agricultural land, it does allow for parcel splits provided the project supports agriculture and the resultant parcels conform to minimum parcel size requirements. TPM No. 5166 satisfies policies in the Land Use and Agricultural Elements that ensure the resultant parcels will be sized to maintain agricultural operations into the future, and that both parcels contain soil types classified as prime farmland capable of supporting continued agricultural operations. Additionally, the applicant is entering both parcels into a Farmland Security Zone contract to further commit the parcels to long-term agriculture.

Although no development is proposed, both newly created parcels would be allowed to develop a home site, by-right, provided standard requirements are met. Prior to Parcel Map approval, the applicant was required to mitigate for the loss of approximately 2.5 acres of habitat due to the potential for future home site development, which has been satisfied with payment of an in-lieu fee. The project implements goals in the 2030 Countywide General Plan that emphasize use of conservation easements and agricultural contracts, and that seek to create a diversified agricultural economy and enhance the agricultural ”working landscape”, while preventing the encroachment of residential, commercial, and industrial uses.

The applicant has satisfied all conditions placed on Tentative Parcel Map No. 5166 and has submitted the final Parcel Map for acceptance by the Board of Supervisors. The TPM meets the Agricultural Intensive (A-N) zone minimum parcel size requirement and satisfies the intent of policies in the 2030 Countywide General Plan that govern the division of agricultural lands.

Staff deemed the final Parcel Map to be in conformity with the approved Tentative Parcel Map, and recommend approval of the final Parcel Map.

The Planning Commission approved Tentative Parcel Map No. 5166 on May 9, 2019. The Office of the County Counsel has reviewed and approved the Parcel Map Acceptance Resolution to form.
