- Determine that the previously adopted Mitigated Negative Declaration (SCH#2007012125) prepared for the project satisfies compliance under the California Environmental Quality Act (CEQA) and Guidelines;
- Approve the amendment to the Emerald Homes Development Agreement to extend the expiration date for the Story residential subdivision (Tentative Map No. 4691) to December 31, 2021; and
- Direct the Clerk of the Board of Supervisors to record amendment.

Reason for Recommended Action/Background |
The Board of Supervisors approved the Emerald Homes Development Agreement (DA) for the Story residential subdivision (Tentative Map No. 4691) in October 2007. The DA had an original term of ten years. In July 2017, the Board took action to extend the DA until November 2019. While Emerald Homes has nearly completed the work necessary to file the Final Map, the applicant has requested a two-year extension, similar to extensions recently approved for the Yocha Dehe Wintun Nation (E. Parker residential project) and Castle Companies (Orciouli residential project) DAs, in order to finalize the work and to consider options.
As currently designed, the Story subdivision, occupying approximately 16 acres in northern Esparto, consists of 78 single-family residential units on varying lot sizes between approximately 3,600 and 7,500 square feet, with homes ranging in size from approximately 1,360 to 1,980 square feet, and includes single-family affordable units. Please refer to Attachment A for a project site map. Changes in the market, among other things, have prompted discussions between Emerald Homes, County staff, and Yolo County Housing to explore alternate possibilities, such as, but not exclusive to, design changes that would result in a product that is more economically feasible to construct, but one that would meet community demand and still satisfy inclusionary housing requirements. Other design considerations could address recent reductions to Esparto's growth boundary in 2019, which eliminated the rural residential designation to the east of the Story site, placing the project adjacent to agricultural land that is now outside the community growth boundary. The applicant has also expressed a desire to engage with the Esparto community through participation with the Citizens Advisory Committee to solicit feedback regarding current community interest. Staff supports the requested two-year term extension and will continue to meet with the applicant and the Esparto community in order to move the project forward.
The framework and requirements for a DA are set forth in provisions of state law, and the approval and any subsequent amendment to a DA require a public hearing before the Planning Commission and Board of Supervisors. A noticed public hearing was held at the Planning Commission on November 14, 2019. A Mitigated Negative Declaration for the Story residential project and Tentative Map No. 4691 was adopted on October 23, 2007 (SCH#2007012125), which satisfies CEQA compliance for the requested two-year term extension. The Esparto Citizens Advisory Committee discussed the request at a special meeting on October 8, 2019, and unanimously recommended approval of the amendment to extend the term to December 31, 2021. The applicant has also reached out to Yolo County Housing to explore alternative solutions for satisfying inclusionary housing requirements, and discussions are ongoing. County Counsel has approved the proposed DA amendment as to form. |
