Reason for Recommended Action/Background
The purpose of the attached Memorandum of Understanding (MOU) is twofold:  to authorize certain near-term habitat restoration actions at the Woodland-Reiff property, located northwest of the City of Woodland (off of County Road 95), and to provide a framework for longer-term conservation actions that are anticipated to include permanent conservation of the restored area. 

The proposed restoration work includes transplanting up to nine elderberry shrubs from land held in trust for the Yocha Dehe Wintun Nation, as well as associated riparian plantings and all necessary maintenance.  The elderberry transplanting is required as a condition of the Tribe's participation in the Yolo Habitat Conservation Plan/Natural Community Conservation Plan (HCP/NCCP) as a "special participating entity" in connection with a tribal road project that will impact the current location of the plants.  All other requirements associated with the Tribe's approval as a special participating entity (i.e., an entity that voluntarily elects to participate in the HCP/NCCP, and is not subject to the land use jurisdiction of a member agency) have been satisfied.

The MOU and associated restoration work is consistent with a Board resolution (Resolution No. 14-126) adopted on December 2, 2014 (Attachment B), in connection with anticipated completion of the Yolo HCP/NCCP.  Through that resolution, the Board expressed the County's intention to assist in HCP/NCCP implementation by, among other things, designating County-owned properties within the boundaries of the Cache Creek Area Plan (CCAP) for future restoration and conservation.  The Woodland-Reiff site is within the CCAP and is already slated for conservation as Swainson's hawk foraging habitat, excepting only about 7.3 acres of the site.  That additional, 7.3-acre area is appropriate for the riparian restoration work described above.

The Conservancy or other third parties will bear all costs associated with the plantings and related restoration, as well as the recording of a habitat conservation easement and related long-term maintenance of the restored area.  The attached MOU is undergoing final review between County and Conservancy staff, and the potential exists for minor edits that are not expected to modify the rights or obligations of either party.
