Brief Title:    Increase Vehicle Registration Fees

Adopt resolution increasing the vehicle registration fee in Yolo County from one dollar to two dollars on motor vehicles, and two dollars to four dollars on all commercial motor vehicles to fund enhanced efforts to prosecute crimes involving vehicle theft and driving under the influence of alcohol and/or drugs. (No general fund impact) (Reisig)
Recommended Action
  1. Adopt resolution increasing the vehicle registration fee in Yolo County from one dollar to two dollars on motor vehicles, and two dollars to four dollars on all commercial motor vehicles to fund enhanced efforts to prosecute crimes involving vehicle theft and driving under the influence of alcohol and/or drugs, per Assembly Bill 767, California Vehicle Code Section 9250.14. Increase will go into effect six months from date of signed resolution; and
     
  2. Authorize the State Department of Motor Vehicles (DMV) to collect the fee on every vehicle registered to an address within Yolo County.

Reason for Recommended Action/Background
On September 30, 1990, the Governor of California signed into law Senate Bill 2139 which authorized counties to impose a fee of one dollar on all motor vehicles and two dollars on all commercial motor vehicles registered within a county.  These funds were to be used to deter, investigate, and prosecute vehicle theft crimes, and depending on the size of the county, could also be used for driving under the influence of alcohol and/or drug crimes.

In November of 1992, a resolution was approved by the Yolo County Board of Supervisors to collect one dollar on all vehicles registered to an address within Yolo County; with these funds, the Vehicle Theft Deterrence Program was created.  Currently, this program funds one DA Investigator II.

On September 6, 2013, the Governor of California approved Assembly Bill 767 which allows an increase in vehicle registration fees from one dollar to two dollars for motor vehicles and two dollars to four dollars for commercial motor vehicles.  The county must submit an approved resolution from their respective Board of Supervisors to the DMV to increase these fees.  The increase will become effective six months from the date the resolution is signed.

We do not anticipate any fiscal impact for fiscal year FY 2019-20 as the increase will not go into affect until the beginning of April at the earliest.  In FY 2020-21, the increased fees will continue to fund the investigator working in the Vehicle Theft/DUI program as well as fund the new cost of impounding vehicles as evidence in felony DUIs involving fatalities.  Currently, the California Highway Patrol is incurring this cost.  However, based on Penal Code 806 and pursuant to the California Attorney General's opinion #85-804, in FY 2019-20, our office will start assuming financial responsibility once criminal charges have been filed.

In the future, we would like to build our own vehicle storage working in collaboration with General Services.  We anticipate using the funds from the increased fees to accomplish this goal.

Vehicle registration fees will not increase until six months after resolution is signed and a certified copy is submitted to the DMV.  For FY19-20, we anticipate no fiscal impact. 

In FY20-21, the anticipated increased fees will continue to fund the investigator working in the Vehicle Theft/DUI program as well as fund the new cost of impounding vehicles as evidence in felony DUIs involving fatalities.  Currently, the California Highway Patrol (CHP) is incurring this cost.  However, based on Penal Code 806 and pursuant to the California Attorney General's opinion #85-804, in FY19-20, our office will start assuming financial responsibility once criminal charges have been filed.
