Recommended Action

Background
On June 24, 2014, the Yolo County Board of Supervisors approved the execution of Agreement No. 14-121, a three-year contract with Tschudin Consulting Group for specialized consulting services relating to the Cache Creek Area Plan program (Minute Order No. 14-94). The original agreement expired on June 30, 2017. A First Amendment (Agreement No. 17-241) was approved on September 26, 2017 to increase the compensation by $100,000 and extend the term by one year through June 30, 2018 (Minute Order No. 17-149). A Second Amendment (Agreement No. 18-149) was approved on July 10, 2018 to increase the compensation by $100,000 and extend the term by one year through June 30, 2019 (Minute Order No. 18-125).

Recommended Action
Staff is recommending that the Board of Supervisors approve a Third Amendment of Agreement No. 14-121 to increase the maximum compensation by $52,400 and extend the contract term by one year through June 30, 2020. The factors driving this recommendation are detailed below.

Increase to Maximum Compensation
There is currently $112,967.18 remaining on the contract. Staff worked with Tschudin Consulting Group to develop the scope of work, identified as Exhibit A-2, that is contained in the contract amendment (Attachment A). Services to be provided during the 2019/2020 fiscal year include the following:
  • Oversight and management of the completion of the Cache Creek Area Plan 20-Year Update
  • Assistance with the development of the Cache Creek Parkway Plan Master Plan and participation in associated public outreach
  • Assistance with implementation of the Cache Creek Resources Management Plan (CCRMP) and Off-Channel Mining Plan (OCMP)
  • Assistance with miscellaneous Cache Creek Area Plan program activities

The cost associated with the above services is calculated to be $165,225. The remaining contract amount of $112,967.18 is not sufficient to fully cover this expected cost, due to extended project timelines, thus requiring an increase to the contract maximum of $52,400. All costs associated with this contract amendment will be covered by revenues collected through the County's Gravel Mining Fee Ordinance.

Extension of Contract Term
There are no new services being proposed in this contract amendment. As mentioned above, the scope of work reflects a continuation of existing services to accommodate extended project timelines, specifically for two major projects: the 20-Year Cache Creek Update Project and the Cache Creek Parkway Plan.

20-Year Cache Creek Area Plan
The CCAP Update was expected to be completed in mid-2018; however, the environmental review component of the schedule was delayed significantly due to an extensive public outreach effort on the Cache Creek Parkway Plan that lasted 13 weeks longer than originally scheduled in late 2017. As a cost-saving measure, and in recognition of the relationship between the two projects, staff originally proposed that the Parkway Plan would be analyzed in the same environmental impact report as the CCAP Update project. To prevent any further delays to the CCAP Update, staff made the decision to move forward with these projects independently. The Draft EIR on the CCAP Update was released on May 10, 2019 for a 45-day agency and public comment review period and the Responses to Comments document was released on August 20, 2019. Together, the Draft EIR and Responses to Comments document comprise the Final EIR on the CCAP Update. Staff is planning to take the CCAP Update package and certification of the Final EIR to the Planning Commission on October 10, 2019 and to the Board of Supervisors in November 2019.

Cache Creek Parkway Plan
Like the CCAP Update project, development of the Parkway Plan was expected to be completed in mid-2018. Although the project's timeline was extended as a result of significant changes to the planning process of this project, which were made in response to the public feedback received during the extended Parkway Plan public outreach process. The main change was the separation, or bifurcation, of the Parkway Plan into two distinct documents to help clarify components of the Parkway that have already been determined (as reflected in the Cache Creek Parkway Baseline Inventory document) from components of the program that continue to be explored (which will be reflected in the Cache Creek Parkway Master Plan). This bifurcation meant that each component of the Parkway Plan development would be completed one after another. The Baseline Inventory document and associated Baseline Inventory Financial Feasibility Study were received and filed by the Board of Supervisors on April 9, 2019 (Minute Order 19-59). The Master Plan document and its financial feasibility study are currently under development and will undergo further public outreach that will take place in late 2019, early 2020.

Staff collaborated with the Department of Financial Services and the Office of County Counsel in the development of this contract amendment.
Competitive Bid Process

The initial agreement entered into with Tschudin Consulting Group in 2014 was a sole source contract. The sole source was approved due to the institutional knowledge of the Cache Creek Area Plan that Tschudin Consulting has obtained over the past 20+ years. Tschudin was involved in the planning, adoption, and implementation of the Cache Creek Area Plan beginning in 1994.

Since the time of original contract execution in June 2014, Tschudin Consulting Group was awarded a three-year on-call consulting services contract through the competitive RFP process initiated by the Department of General Services in Spring 2017 and formally approved by the Board of Supervisors in June 2017. If this third amendment is approved, this request will result in the extension of a sole sourced contract. The services specified in the scope of work are in support of projects that are currently underway. There are no new services or project proposed in this request. New projects or services, if necessary, will be authorized through the competitively awarded on-call consulting services contract held by the Department of General Services or another competetive process.
