Recommended Action

Reason for Recommended Action/Background
On-Call Consultant Contracts: Background
Ninety-eight on-call consulting contracts were approved by the Board of Supervisors on June 6, 2017.  When approved, the Board stipulated that any project that is awarded to an on-call consultant is subject to a review process that, depending upon the size of the contract, may include the County Procurement Agent, the County Administrator's Office, or the Board of Supervisors.

In compliance with County Administrative Policies & Procedures Manual, the County General Services Director is authorized to approve services for emergency work and other non-grant funded repair, construction, and/or urgent design projects under $100,000 with approval from the County Purchasing Agent and/or the County Administrators Office depending upon project funding. All projects awarded that are over $100,000 or any grant funded work will be brought to the Board of Supervisors for approval. On-call consultant contracts may be utilized for work on a non-emergency basis, but they do not preclude the County from seeking other firms on the basis of requests for qualifications for any other major project.

Requested Work Order Authorization Approval
The $112,000 work authorization for Consero Solutions (Attachment A) consists of:
  • $40,000 in reimbursable work related to the "Yolo Bypass Wildlife Area Habitat and Drainage Improvement Project", and
  • $72,000 in previously budgeted work related to the ongoing work undertaken by the Board's "Delta, Flood and Related Issues" Ad Hoc Subcommittee.
Project Management for Yolo Bypass Wildlife Area Habitat and Drainage Improvement Project
The Yolo Bypass Wildlife Area Habitat and Drainage Improvement Project is an implementation project with the goals of enhancing habitat for migrating waterfowl and other species, improving agricultural sustainability and wildlife friendly agricultural practices, and increasing public access opportunities at the Yolo Bypass Wildlife Area. The project will create 220 acres of wetland and improve water management on 1,250 acres of existing wetlands and 540 acres of agricultural land. 

This project will be implemented by Ducks Unlimited with funding secured through a grant funding agreement with the Sacramento-San Joaquin Delta Conservancy.  The County has executed a reimbursement agreement, provided as Attachment C, with Ducks Unlimited in the amount of $40,000 to fund the project management work described in the work order authorization. Consero has a longstanding relationship with the Delta Conservancy, the source of the construction funding for this project, and has successfully managed other grants from the Delta Conservancy to completion.  Because of this relationship and demonstrated record of success the Delta Conservancy specifically requested that Consero remain involved in the implementation of the project and provided funding in the grant agreement with Ducks Unlimited for these services. 

Professional Services: Delta, Flood and Related Issues Subcommittee
Consero Solutions will provide professional consulting services pertaining to the County’s Delta , Flood and Related Issues advocacy program including WaterFix, EcoRestore, the DWR - FESSRO Central Valley Flood System Conservation Strategy, the Delta Counties Coalition, and the federal Biological Opinion process. Consero will assist the County Administrator’s office with the evaluation of state and federal proposals to increase Yolo Bypass inundation for fish habitat and expand the Yolo Bypass for flood protection, as well as other duties as assigned.

Consero Solutions will also provide review of environmental documents, facilitation of public meetings and management of stakeholder outreach for projects related to the Yolo Bypass Working Group and its role in developing locally preferred alternatives for the implementation of the Biological Opinions.

The County is in the midst of negotiations that are intended to avoid litigation with various state and federal agencies over agricultural and economic impacts that will result from the implementation of state/federal projects in the Delta and Yolo Bypass.
Consero has been involved all aspects of these on-going efforts, including directing the work of sub-consulting agricultural economists for the purpose of quantifying impacts to the County and regional economy. Staff anticipates that these negotiations will continue through the first half of FY 2019-20.

County Administrators Office, Department of Financial Services, Office of County Counsel, General Services Department, the Sacramento - San Joaquin Delta Conservancy, and Ducks Unlimited.
Competitive Bid Process
On-call contracts were solicited and reviewed in compliance with all Department of Financial Services policies and procedures.  Contracts were approved by the Board of Supervisors in June 2017.

A sole source was approved for this contractor in September 2018 resulting in a one year work order authorization.  The contractor was awarded a three-year on-call contract in 2017 and a subsequent work order authorization was issued to continue the work underway since 2016. This work order authorization will allow staff and the consultant to complete the projects referenced above. Board approval is required because the total compensation will exceed $100,000.  A competitive RFQ/RFP will be issued prior to the conclusion of FY 19/20 should these services be needed next fiscal year.
