Recommended Action |
- Adopt resolution approving the request from the Yolo Land Trust to partially fund the acquisition of an agricultural conservation easement and the creation of a stewardship endowment using $100,532 from the In-Lieu Agricultural Mitigation Fee Account for the easement on the Haag walnut orchard, just north of Esparto; and
- Authorize the Director of the Department of Community Services to take all steps necessary for the completion of the conservation project.

Reason for Recommended Action/Background |
On April 24, 2018, the Board of Supervisors adopted Resolution No. 18-48, which approved a proposal by the Yolo Land Trust to acquire an agricultural conservation easement on the Haag walnut orchard, just north of Esparto. The fair market value of the easement is $885,000. Pursuant to the proposal, the Yolo Land Trust acquisition will be funded by a combination of sources. Most significantly, a grant award by the California Department of Conservation, through its Sustainable Agricultural Lands Program, will fund $607,500.
The Yolo Land Trust is requesting $60,750 from the County In-Lieu Agricultural Mitigation Fee Account, which represents a 10% match of the Department of Conservation grant. In addition, the Yolo Land Trust is requesting a Stewardship Endowment from the County In-Lieu Agricultural Mitigation Fee Account in the amount of $39,782. The balance of the acquisition costs will come from the Yolo Land Trust’s restricted funds and the property owner.
The In-Lieu Agricultural Mitigation Fee Account was created by the Board of Supervisors through the adoption of Ordinance 1373 on May 6th, 2008. Section 10(A) of the Ordinance states:
“The Fees Collected pursuant to this ordinance may be spent for the conservation of agricultural lands though purchase of conservation easements, including any related administrative, monitoring, stewardship, and legal costs.“
In total, the Yolo Land Trust is requesting $100,532 from the County In-Lieu Agricultural Mitigation Fee Account. The requested amounts are eligible uses of the funds because they will be used to acquire an agricultural conservation easement and to fund a stewardship endowment for an agricultural conservation easement. The proposed action will not impact the General Fund. There are sufficient funds in the In-Lieu Agricultural Mitigation Fee Account for the request, which is included in the Department of Community Services approved budget.
Staff recommends that the Board of Supervisors adopt the attached resolution authorizing the transfer of funds from the In-Lieu Agricultural Mitigation Fee Account to the Yolo Land Trust. |
