Approve contract with EEI WSD Joint Venture for immediate and necessary repairs and maintenance to the Wild Wings Wastewater Recycling Facility for an amount not to exceed $598,486 for the term December 17, 2017 to December 31, 2018; authorize the Assistant County Administrator or designee to execute amendments to the agreement as needed within a 15% contingency ($89,733); and adopt budget resolution increasing the Wild Wings County Service Area sewer and water funds' 2017-18 budget by $472,086 and $126,400 respectively, utilizing fund balance. Recommended Action
  1. The Board finds substantial evidence that the repairs to be made pursuant to the contract are necessary, constitute an emergency and do not permit a delay resulting from a competitive solicitation for bids, and that the contract approval is necessary to respond to the emergency;
     
  2. Approve contract with EEI WSD Joint Venture for immediate and necessary repairs and maintenance to the Wild Wings Wastewater Recycling Facility for an amount not to exceed $598,486 for the term December 17, 2017 to December 31, 2018;
     
  3. Authorize the Assistant County Administrator or designee to execute amendments to the agreement as needed within a 15% contingency ($89,733); and
     
  4. Adopt budget resolution increasing the Wild Wings County Service Area sewer and water funds' 2017-18 budget by $472,086 and $126,400 respectively, utilizing fund balance.

Reason for Recommended Action/Background
Following recent evaluations of the Wild Wings Wastewater Recycling Facility and related operations, the County has become aware of immediate and necessary repairs and maintenance required to continue to operate the facility safely and in compliance with the County's wastewater discharge permit. Violation and potential revocation of the discharge permits would place the County in violation of environmental discharge laws, and uninterrupted operations of the facility and related operations, including discharge to the golf course, is necessary to provide wastewater service and treatment to the residents and customers of the Wild Wings County Service Area.

Some of the repairs to the facility are related to monitoring systems (SCADA) on which the community's water system also relies.  As such, this action also impacts the water delivery system and the water fund as outlined in Exhibit A - SCADA Goals of the agreement.

EEI WSD installed the original system and have specialized expertise in installing and repairing packaged wastewater treatment plants. Substantial evidence exists that the emergency repairs needed will not permit a delay resulting from a competitive solicitation for bids, and that the approval of this agreement is necessary to respond to the emergency.

Further explanation as needed:
It is anticipated the work required to address the emergency needs at the Wastewater Recycling Facility will exceed the CSA's sewer funds and it will likely be necessary to borrow funds later in the fiscal year. The County Administrator's Office will work with the Department of Financial Services to develop a plan of action, including a funding analysis to determine whether these repairs can be absorbed by the CSA's other resources or if external borrowing is necessary, as well as the CSA's ability to borrow and repay funds.
