Hold a public hearing continued from January 23, 2018 on the appeal of the Planning Commission's approval of a Use Permit for the construction and operation of three temporary meteorological wind towers located within an approximately 10 mile-long area near the ridgeline of the Capay Hills, ranging from east of Brooks to east of Rumsey (APNs: 061-150-002, 059-180-007, and 059-090-009). Recommended Action |
- Hold a de novo public hearing continued from January 23, 2018 to consider public testimony on the appeal (Attachment A) of the Planning Commission's approval of a Use Permit for the construction and operation of meteorological wind towers (Attachment B);
- Adopt the Mitigated Negative Declaration, and Mitigation Monitoring and Reporting Plan as the appropriate level of environmental review in accordance with the California Environmental Quality Act (CEQA) and CEQA Guidelines (Attachment G); and
- Approve the project with the Conditions of Approval (Attachment C), and adopt associated findings (Attachment D).

Reason for Recommended Action/Background |
On January 23, 2018, the Board of Supervisors conducted a de novo public hearing on the appeal from the Planning Commission's approval of three met towers. Following public testimony and deliberation, the Board voted to continue the public hearing to this date and directed staff to work with the applicant and the appellant (Yocha Dehe Wintun Nation) to establish a process by which tribal staff would monitor the erection of the meteorological towers and ensure that no significant impacts to cultural resources at the sites would occur.
The parties have met and conferred on the wording of a new Condition of Approval that addresses cultural resources monitoring. However, the wording of the new condition has not been responded to by the Tribe. Additionally, the applicant has proposed a modification to project so that one of the three proposed towers would not be constructed (Site #1 outside Brooks, near the area of the original Yochadihi village). The Tribe has asked that Tower 2 be moved, but the applicant maintains that this location is necessary to measure the conditions in the area. |
