Recommended Action
  1. Approve renewal agreement with the California Department of Health Care Services specifying the performance requirements for locally provided mental health services with no direct funding for the period July 1, 2017 through June 30, 2018.
  2. Delegate authority to the Director of Health and Human Services Agency and/or her/his designee to sign and execute any additional forms, documents and/or amendments as necessary relating to this agreement, provided there are no significant programmatic changes or increases in funding.

Reason for Recommended Action/Background
The Department of Health Care Services (DHCS) Performance Agreement specifies the terms, conditions and requirements for Mental Health Services Act (MHSA), Projects for Assistance in Transition from Homelessness (PATH), Community Mental Health Services Grant (MHBG) and any mental health services funded with realignment dollars. The general requirements are specified in section 5651 of the Welfare & Institutions Code, and in the Agreement, which includes the following:
 
  • Comply with the expenditure requirements,
  • Provide services to persons receiving involuntary treatment,
  • Comply with all of the requirements necessary for Medi-Cal reimbursement for mental health services,
  • Ensure that the Local Mental Health Advisory Board has reviewed and approved procedures ensuring citizen and professional involvement at all stages of the planning process,
  • Comply with all provisions and requirements in law pertaining to patient rights,
  • Comply with all requirements in federal law and regulation pertaining to federally funded mental health programs,
  • Provide all data and information both set forth in the Welfare & Institutions Code and specified in the Agreement,
  • Comply with all applicable laws and regulations for all services delivered, including all laws, regulations, and guidelines of the Mental Health Services Act. 
The County must comply with all of the requirements delineated in the Agreement; and, all of the requirements that pertain to the specific programs which includes MHSA, PATH, MHBG, and similar programs.  DHCS monitors this Agreement to ensure that the County is compliant with applicable federal and State law and regulations.

The Health and Human Services Agency (HHSA) management team and Quality Improvement/Compliance staff are responsible for ensuring compliance with the performance standards specified in this Agreement and, through the continuous review and monitoring of the program and fiscal performance of county operated and contract provider operated services to ensure that program integrity standards are met, that necessary corrective actions are taken upon discovery of any non-compliance, and future risks for non-compliance are mitigated.  Currently, HHSA meets all of the performance standards identified in this Agreement.
 
This is a standard Agreement issued by DHCS to all of the California counties.  This agreement was received by Yolo County HHSA on October 25, 2017.

No county general funds are required by this action. This agreement does not involve funding directly; however, funding for several of the local mental health programs covered by this Agreement, [e.g., the Mental Health Services Act (MHSA), Projects for Assistance in Transition from Homelessness (PATH), and Community Mental Health Services Grant (MHBG) programs] are awarded under separate agreements, grants, and initiatives that are presented to the Board of Supervisors for approval individually or as part of the annual budget.
