As this agreement is being made between two government entities, action by the Board of Supervisors is required per Government Code 23005.
There has been an on-going problem between off highway vehicle riders and land owners within Yolo County. Complaints from land owners related to off highway vehicle riders trespassing and vandalizing private property continue to be received. Land owners along the areas where most problems occur have gone to great lengths to prevent riders from entering their property; however, people continue to break through the physical barriers, gates and fencing to access those areas. Other areas of concern are habitat restoration sites along Putah and Cache Creek. With OHV grant funds the Sheriff's Office can patrol and protect these valuable projects.
In addition to the problems created by trespassing, there also arises the problem of patrol deputies being equipped to respond to scenes in case of an incident. The area where most off highway vehicle use occurs is both rugged and rural. It can not be accessed by traditional patrol vehicles. To help augment enforcement efforts, the Yolo County Sheriff's Office first sought OHV grant revenue funding in fiscal year 2009-2010 and subsequent fiscal years. This funding has allowed the department to purchase equipment and provide specific training and resources needed to help establish an enforcement team, better serving landowners negatively affected by OHV riders. In fiscal year 2014-2015 the program was expanded to increase the number of deputies available to patrol for illegal activity.
On September 26, 2017, the Yolo County Sheriff's Office received authorization to submit the fiscal year 2017-18 application for the Off Highway Vehicle Recreation Program via Yolo County Resolution No. 17-116. The state has now granted the Sheriff’s Office $68,216 in grant reimbursement funding for fiscal year 2017-18. The required matching funds for this grant are $22,739. |

| The Yolo County Sheriff's Office has been and will continue to work in cooperation with other departments within the county such as the County Administrator’s Natural Resources Division and the General Services Parks Division to help develop long term solutions to these issues. County Counsel has approved resolutions as to form. |

| The $68,216 grant requires a local match of 33% ($22,739), which can be fulfilled by either in-kind goods and services or utilization of other county funds. In this case, the match requirement will be satisfied by existing funds ($12,739) from the local funding source established by Vehicle Code 38240 and $10,000 in "gravel funding" from Natural Resources. No county general or public safety funds are involved for fiscal year 2017-18. The reimbursement grant funds will be used to support increased patrol efforts along the Cache Creek recreational areas. |
