Reason for Recommended Action/Background |
The Public Employees' Pension Reform Act of 2013 (PEPRA) and government code 7522.6 requires that individuals who retire from a CalPERS agency wait 180 days before being reemployed by the same or another CalPERS agency, unless the individual chooses to reinstate from retirement. Government code 7522.6 allows exceptions to this 180-day waiting period under certain specified circumstances including the appointment to a position that is certified by the public agency's governing body as being critically necessary.
The Health and Human Services Agency currently has a significant need to fill the dual roles of County Health Officer and Physician to perform State mandated public health services for the County's residents. Our current Health Officer / Physician will be retiring on August 8, 2015. Human Resources opened a continuous recruitment for County Health Officer and Physician in May, 2015 and while recruitment efforts are underway, a final candidate has not yet been selected. As the recruitment proceeds, the department is requesting that the current employee be able to return as a retiree, with exception to the 180 day waiting period, to assist us in an extra help, limited term retired annuitant capacity while we complete the recruitment process. Under Government code 7522.6 and 21221(h), this retired annuitant appointment requires board action.
Staff recommends Board of Supervisor approval of the attached Resolution, with attached Retiree Eligibility Form, in order to allow the County to maintain mandated public health services with this qualified and available Physician, while the recruitment is ongoing. |
