Recommended Action
  1. Adopt resolution (Attachment A) updating Resolution No. 15-72, which established a set-aside account in the Division of Integrated Waste Management's fund to serve as the financial assurance mechanism for the Mining Reclamation Plan for the landfill's soil borrow site, to update set-aside amount to $577,899 for fiscal year 2021-22, and authorize annual updates to the set-aside amount based on approved reclamation plan cost estimates; and
     
  2. Authorize the Department of Financial Services to take the necessary actions to implement the resolution.

Reason for Recommended Action/Background
On June 9, 2015, the Board approved the Central Landfill Borrow Site Project, which provided a new source of soil for the Yolo County Central Landfill (YCCL). The Landfill needs a steady supply of soil to support a variety of operations, including daily and intermediate cover, final closure of individual landfill modules, and construction of new modules. These activities are required to ensure continued compliance with state solid waste requirements.
 
A Reclamation Plan for the project was prepared and submitted to the California Department of Conservation, Office of Mine Reclamation, as required by the State Surface Mining and Reclamation Act. A detailed cost estimate and proof of financial assurance are also required to be submitted and approved by state and local agencies prior to any soil removal to ensure that the funds required to complete remediation of the borrow site will be available when needed. The Financial Assurance Cost Estimate (FACE) is currently updated annually and approved by state and local regulatory agencies.
 
On July 7, 2015, the Board approved Resolution No. 15-72 to establish a budget account set-aside to be the financial assurance mechanism. The initial estimated cost for reclamation of the entire site was $466,879, the updated estimated cost for this upcoming fiscal year is $577,899 (Attachment B). As stated in the Reclamation Plan, the entire amount won't be required to be spent in one lump sum. The division plans to remediate the site in three sections, during the estimated 50-year excavation period for the site. Therefore, the set aside account will be adjusted each year to reflect changes in estimated costs and following completion of remediation of individual sections.
 
The division will work with the Department of Financial Services to take the necessary actions to implement the resolution and submit the required financial assurance documents to the Planning Division and state Department of Conservation.
