Recommended Action
  1. Approve agreement with Westervelt Ecological Services, LLC for the purchase of 0.21 acres of environmental mitigation credits from the Bullock Bend Mitigation Bank for the County Road 29 Bridge Replacement Project over Dry Slough for a cost of $35,700; and
     
  2. Authorize the Director of Public Works to sign the agreement and approve payment.

Reason for Recommended Action/Background
The approved environmental documents for this project require compensatory mitigation for the permanent loss of the habitat for endangered species and seasonal wetlands impacted by the project.  Bullock Bend Mitigation Bank has mitigation credits available for purchase that will satisfy these requirements. 
 
Background
The bridge is located on County Road (CR) 29 over Dry Slough, approximately 0.77 miles west of CR 98, north of the City of Davis.  The existing 21-foot wide bridge built in 1930 was classified by Caltrans as functionally obsolete with a sufficiency ratio of 39.6 of 100.  The new bridge will be 32-feet wide comprised of two 12-foot lanes and four-foot shoulders.  The CEQA mitigated negative declaration for this project was approved on January 10, 2017.  The NEPA categorical exclusion was approved on March 9, 2017.
 
As part of the environmental approvals, the California Department of Fish and Wildlife (CDFW), the United States Fish and Wildlife Service (USFWS), and the Caltrans-approved NEPA Categorical Exemption require the purchase of mitigation credits to compensate for impacts to the Riparian Habitat and Riparian Wetlands.  Mitigation credits must be purchased from an approved mitigation bank.  The mitigation bank uses the funds to develop and maintain habitat in accordance with procedures of environmental resource, state and federal agencies like USFWS and CDFW.
 
The purchase includes 0.21 Salmonid Riverine Riparian/SWHA Nesting (Restored) credit from Bullock Bend Mitigation Bank. Following the purchase of these mitigation credits, the County will have satisfied these requirements of the environmental documents and permits.

Competitive Bid Process
The environmental documents for this project were approved before the Yolo Habitat Conservation Plan (HCP) guidelines were established and implemented. The process to mitigate through the HCP would require additional environmental surveys and additional review of the approved environmental documents, because the methods required by the HCP are different than those done in the approved documents. Although the credit cost was estimated to be comparable to the costs from the other banks, the revision of the approved environmental documents would create additional costs to the project. Additionally, Yolo HCP does not have all the mitigation credits required for the project, which means that the County would need to mitigate through two mitigation banks to satisfy all mitigation requirements.  

The CDFW required the mitigation credit be purchased from Bullock Bend Mitigation Bank.

The approved FY 2020/21 road fund budget includes sufficient funds for environmental mitigation for this project.  The total cost will be reimbursed by federal transportation funds at a rate of 100%.
