Recommended Action |

BACKGROUND
In March of 2017, Yolo County Public Works was notified that an unmaintained portion of County Road 41 was being undermined by erosion in Cache Creek. Staff visited the site and documented the condition finding it unsafe for public use. The road shoulder had been washed out in a recent storm and created a steep drop of roughly 30 feet from the edge of the road down to the creek. Gates that had been installed in 2010 when the County ceased road maintenance were subsequently locked by County staff to prevent public access and keys were provided to land owners to access private lands when necessary.
In January and February of 2019 more erosion occurred, this time several hundred feet of road was washed out making the right-of-way impassable. As a result, the land owners (Yocha Dehe Wintun Nation and Mr. Gage Hutchens) along with the Capay Valley Fire Protection district were forced to use alternate routes for access. The Tribe was forced to access their lands from the north through Colusa County and Mr. Gage Hutchins was restricted to accessing his property through the right-of-way in the summer months when the bank was stable.
The Board of Supervisors has received correspondence from local residents and firefighters urging the Board to re-establish this road, as it is identified as a critical evacuation route for area residents in case of wildfire.
REASON FOR RECOMMENDED ACTIONS
To resolve the issue, new right-of-way must be purchased and a new road constructed such that access to Mr. Hutchens’ property (Assessor’s Parcel Number 060-270-001) is restored and connection is provided for both segments of County Road 41. There are currently two solutions (Att. A - Alternatives Map) evident for replacing the right-of-way and both have advantages and disadvantages.
Alternative 1 is shorter and would require approximately 920 feet of new road involving 3 different property owners while Alternative 2 is approximately 1780 ft long with an arroyo crossing and would require significantly more right-of-way from 4 different property owners. Costs for Alternative 1 are estimated at $175,000 and is preferred given the shorter distance and reduced impact to the landowners however slope stability is a concern and will need to be studied prior to pursuing this option. Alternative 2 is estimated at $350,000 with increased costs due to an 80 ft arroyo crossing and increased road length however long-term stability would not be not a concern.
Staff recommends that the Board receive this update and direct staff to further investigate Alternative 1 to determine the long-term viability of this alignment given that it is the low cost alternative, and minimizes impacts to private property owners. Staff also recommends that the Board authorize staff to pursue Alternative 2, if a geotechnical investigation finds Alternative 1 to be unfeasible. |
