Recommended Action
  1. Initiate the proceedings to evaluate the potential vacation of a portion of County Road 100B on Assessor’s Parcel Numbers 027-250-005 and 027-250-006; and
     
  2. Direct the Clerk to set the hearing date for March 28, 2021.

Reason for Recommended Action/Background
The purpose of this item is to initiate the evaluation and public outreach process for potential vacation of a portion of County Road (CR) 100B.  Whether or not to vacate the road will be evaluated and decided at the ensuing public hearing to be set by the Board.
 
Clark Pacific has submitted a request to vacate County Road 100B between CR 18A (Best Ranch Rd) and CR 18C.  Clark Pacific is the sole property owner along both sides of the road. The roadway is also accessed by the public including neighbors living and/or farming on CR 100B north of CR 18A. County Road 18C provides direct access to CR 102 to the east and State Route (SR) 113/East Street to the west. County Road 18A provides direct access to SR 113. The latest traffic counts prepared for CR 18C in 2014 reveal that a majority of the traffic using CR 18C heads west to SR 113.
 
Clark Pacific’s concrete manufacturing plant is bisected by the portion of CR 100B that lies between CR 18C and Best Ranch Road (CR 18A).  The western side of the plant includes pouring and welding facilities, and sandblasting and painting areas that are used to manufacture large concrete panels; the eastern side of the plant is used as a curing site for storing and drying the panels and includes a solar field and hazardous waste facility. Large mobile construction cranes are used regularly to transport the heavy concrete panels from the western side of the plant to the eastern side of the plant, requiring frequent road closures, which cause safety and security issues and result in significant operational inefficiencies.
 
On January 21, 2021, the Planning Commission held a public hearing to consider whether the requested vacation conforms with the Countywide General Plan under the provisions of Streets and Highways Code Section 8313 and Government Code Section 65402(a). A copy of the Planning Commission staff report is attached to this report (Att. C). Given the Commission’s limited scope of review, a determination was made that the road vacation request conforms to the General Plan and staff was directed to report the findings to the Board of Supervisors. However, some Commissioners expressed concern over the limited scope of their review. During the public hearing, several residents voiced concern as CR 100B provides critical access for farm equipment. If the abandonment were to be approved, the remaining access along Best Ranch Road has limited width and wouldn’t allow for wider equipment and implements to pass. Hearing these concerns, the Planning Commission requested that the application return to the Commission for a recommendation on the vacation itself before the item went to the Board of Supervisors.
  
REASON FOR RECOMMENDED ACTIONS
 
Streets and Highways Code Section 8320 provides that a legislative body (in this case the Board of Supervisors) can initiate the road vacation proceedings.  Initiating the process does not mean the Board is taking any position on the actual abandonment; it simply directs staff to issue public notice and conduct additional outreach.  Staff is recommending that the Public Hearing be set for March 9, 2021.
 
The applicant is currently exploring the feasibility of providing suitable farm vehicle access for the farming operations north of Best Ranch Road. If such arrangements are feasible, staff recommends that the documentation for an easement be presented at the hearing along with the road vacation and become a condition of approval.
 
After the vacation process is initiated, County staff will continue to work with local residents and Clark Pacific to ensure negotiations proceed accordingly.
