Recommended Action
  1. Approve the Memorandum of Understanding (MOU) with the Yolo Habitat Conservancy (Attachment A) regarding restoration and conservation activities on the County-owned Correll property (APN 025-340-036); and
     
  2. Authorize the County Administrator, or his/her designee, to execute the MOU.

Background
The Correll property is owned by Yolo County and located within the Cache Creek riparian corridor. The parcel was donated to the County in 1996 and is located within the Cache Creek Resources Management Plan area. As recently as the 1980s, the parcel was mined for aggregate resources by Lone Star. The parcel totals nearly 39 acres and is the eastern end to the Cache Creek Parkway. There is no address established for this parcel (APN 025-340-036) which is located in District 5, just east of County Road 96 and south of Cache Creek. Location maps are provided as Attachment B to this staff report.

On December 2, 2014, the Board adopted Resolution No. 14-126 (Attachment C), which supported the development of a partnership between the Yolo Habitat Conservancy and the dedication of 250-660 acres of conservation easements to the Yolo Habitat Conservancy, so long as:
  1. The easements are consistent with the Cache Creek Parkway Plan and the Cache Creek Resources Management Plan;
  2. The Yolo Habitat Conservancy funds the costs associated with any such easements; and
  3. The Yolo Habitat Conservancy pays for all associated habitat maintenance into perpetuity.
It is staff's intent to work with the Conservancy to donate a conservation easement on this parcel in the near future. Any future easement will return to the Board for it's consideration.

Current Request
The Yolo Habitat Conservancy Board has previously approved the inclusion of the Correll property as a candidate Yolo HCP/NCCP conservation easement site on May 18, 2020. In addition to the site being identified as a candidate conservation easement site, the Conservancy’s Science and Technical Advisory Committee (STAC) has also identified the site as being suitable for the planting and transplanting of elderberry shrubs as needed to mitigate for potential impacts to valley elderberry longhorn beetle (VELB). While the Conservancy does not currently have applications for HCP/NCCP coverage that require VELB mitigation, it is anticipated that several projects seeking HCP/NCCP coverage within the next 1-3 years will need VELB mitigation.

The purpose of the attached Memorandum of Understanding between Yolo County and the Yolo Habitat Conservancy is two-fold:
  1. It provides a framework under which the Conservancy will coordinate with the County to complete the establishment of a conservation easement and VELB mitigation areas on the property, and
  2. It authorizes near-term site access to Conservancy representatives and contractors as necessary to complete due diligence activities required by the HCP/NCCP.

At this time, staff recommends that the Board approve the MOU with the Yolo Habitat Conservancy and authorize the County Administrator, or his/her designee, to execute the MOU.
