Recommended Action
  1. Approve second amendment to Agreement No. 17-99 with Kitchell CEM to extend the contract through July 31, 2022; and
     
  2. Approve work authorization in the amount of $411,220 to provide continuing construction management services for the SB 863 Leinberger Replacement Project.

Reason for Recommended Action/Background
In the first quarter of 2017, the County issued a Request for Qualifications (RFQ) for construction oversight for the Yolo County SB 863 Leinberger Replacement Project. At the conclusion of the competitive bid process, the County awarded a Times and Materials based contract to Kitchell CEM and a work authorization was issued In October 2017. On July 24, 2018, the County issued a first amendment to the work authorization to increase the work authorization amount by $339,660 for total compensation of $934,660 and extended the contract period date to June 30, 2021. The changes to the contract were needed due to delays in receiving approvals from the State of California and to continue construction management and allow the project to continue.

Due to continued delays by the State of California and the onset of the COVID-19 pandemic, the approval by the State of the Ground Lease Agreement caused significant delays in the overall project schedule.  All proper documentation was sent to the State of California in September 2019; however, Yolo County did not receive approval until December 2020.  During the delay period, Kitchell increased their fees. As a result of the delays, the timeline for the project has extended nine (9) months from November 2021 to July 2022 and the total cost of the times and materials to complete the project has increased by $411,220.

This second amendment will increase the work authorization by $411,220 for total compensation of $1,345,880 and extend the contract period to July 31, 2022.

The Yolo County SB863 Leinberger Replacement Project is funded by a grant from the Board of State and Community Corrections (BSCC). The County received SB 863 Adult Local Criminal Justice Facilities Financing Program funds in the amount of $30,500,000 from BSCC. The total project budget of $36,000,000 also includes a $5,143,000 cash match and $357,000 in-kind match. The cash match is funded by CIP Bond Proceeds.

Competitive Bid Process
The County issued an RFQ in early 2017 for urgent on-call architectural, environmental, engineering and other consulting services. A panel consisting of representatives from the County Administrator's Office, County Counsel and the General Services Department reviewed and scored the 92 responses and recommended issuing contracts to 70 of those who submitted. While many responses were from qualified firms, Kitchell CEM had the most experience with correctional facility construction.
