Recommended Action
Staff recommends that the Board of Supervisors, sitting as the governing body of County Service Area 6:
 
  1. Adopt resolution accepting funds for 2019-20 Flood Maintenance Assistance Program funding for Yolo County Service Area 6;(Attachment A);
     
  2. Authorize the County Administrator, or his/her designee, to execute the associated Funding Agreement, and any subsequent documentation, modifications, or amendments.

Reason for Recommended Action/Background
Knights Landing Unit 2 - Yolo Bypass - County Service Area 6 ("CSA 6") levee system is a portion of the Sacramento River Flood Control Project, a large-scale levee project authorized by Congress. This system reduces the risk of flooding for Yolo and Sutter County and adjacent agricultural lands from flood waters in the Sacramento River, Knights Landing Ridge Cut, and Colusa Basin Drain. A non-urban population and a small number of structures are present within the leveed area. The Central Valley Flood Protection Board is a non-federal sponsor and has delegated authority to Yolo County CSA 6 for operation and maintenance of the levee system.

The California Department of Water Resources ("DWR") has recently implemented a new program called the Flood Maintenance Assistance Program ("FMAP"). The FMAP program provides State funds for eligible maintenance activities to Local Maintaining Agencies and Maintenance Areas. The purpose of this program is to help ensure that State Plan of Flood Control Facilities are properly maintained and have sufficient resources, such as funding, to meet applicable federal regulations and operation and maintenance manual requirements. An important component of this program is that no local matching funds are required to obtain the State funding.

CSA 6 was a successful recipient of $85,000 in FMAP funding to perform deferred maintenance activities for the 18/19 fiscal year. The funding agreement and associated resolutions were approved by the Board of Supervisors on May 21, 2019 (Minute Order No. 19-69).

After the submittal of a proposal solicitation package in July 2019, DWR notified Natural Resources Division staff that CSA 6 is eligible to receive additional FMAP funding for the 19/20 fiscal year funding cycle. Funds to be received will be used for the continued implementation of deferred maintenance activities that were funded from the 18/19 cycle. These activities include general levee maintenance (clearing debris, removing illegal encroachments, etc.), vegetation control (burning, spraying, slope dragging, etc.), and rodent control (baiting, trapping). It is important to note that there is no match required to obtain the FMAP funds.

At the time of drafting this staff report, staff has not received confirmation from DWR as to the final amount of funding that will be provided for this next round of funding. However, the adoption of the Resolution Accepting Funds is the first action that must take place in order for CSA 6 to participate in the FMAP program. It is expected that the funding agreement will become available at the end of September 2019. Since the FMAP program does not involve any matching funds, staff is requesting that the Board of Supervisors authorize the County Administrator, or his/her designee, to sign the funding agreement with County Counsel concurrence, once the agreement becomes available.
