Recommended Action
Adopt resolution authorizing the Sheriff's Office to access Federal, State and Local level criminal history information for the employment of Animal Services Officers under Penal Code Section 830.9.

Reason for Recommended Action/Background
The Sheriff's Office currently performs Livescan fingerprinting for employment, licensing, and other certification and permitting purposes. Each application type is specifically coded to return summary criminal history information from state, local, and/or federal sources, depending on the clearance criteria needed.

Under Penal Code 830.9, Animal Services Officers are permitted to carry and use firearms.  In order to conduct the appropriate Livescan clearance required for employment of Animal Service Officers, the Sheriff’s Office will need to receive Board authority to obtain Federal, State and Local level criminal history information under this application type. Penal code Sections 11105(b) (11) and 13300(b) (11) require the city council, board of supervisors, governing body of a city, county or district or joint powers authority to specifically authorize an agency's access to summary criminal history information for employment, licensing, or certification purposes.

The Sheriff's Office is now requesting Board authority to obtain access to Federal, State and Local level criminal history information for the employment of Animal Services Officers.

There is no fiscal impact to the Sheriff's Office for this action.  The Sheriff’s Office currently conducts Livescan for Animal Service Officers for employment and the adoption of the resolution would allow the Sheriff’s Office to access Federal, State and Local level criminal history information. The current total fee for this service is $61.00 per application (Fee breakdown is as follows: Livescan rolling fees $12.00, Department of Justice fees $32.00, and Federal Bureau of Investigation fees $17.00). The applicant will be required to obtain security clearance on a yearly basis.
