Recommended Action
  1. Authorize staff to initiate proceedings to consider proposed changes in the water and sewer fees for the Wild Wings County Service Area (CSA);
     
  2. Direct staff to mail notice of the public hearing to consider a proposed fee increase for water and sewer service to property owners within the Wild Wings CSA at least 45 days before the public hearing, including notification of the opportunity to protest the proposed fee changes;
     
  3. Direct staff to set the time and date of the public hearing to consider the proposed fee changes and to receive and consider all public comment, including but not limited to, any protests against the proposed fee changes; and
     
  4. Direct staff to prepare a resolution adopting and levying the modified water and sewer fees for the Wild Wings CSA in the event the increase is not successfully protested.

Reason for Recommended Action/Background
The recommended actions are to initiate the process for the Wild Wings CSA to adopt a water and sewer fee change to cover the costs of providing water and sewer service in the CSA. Per the April 10, 2018 Engineer's Fee Report update (Att. A), the current water fee is adequate for providing water service, and in fact, can be slightly reduced.  The sewer fee, however, is not adequate and as such, sewer service to the community will be adversely impacted unless a fee increase occurs. Besides adjusting the sewer fee to meet today's operating costs and anticipated capital repairs/replacements, a portion of the fee increase will be to repay a loan from the water fund. 

In December of 2017, major rehabilitation of the wastewater recycling facility was required due to a lack of redundancy in the wastewater treatment plant, deferred maintenance and State discharge permit compliance. The costs were significant, exceeding the CSA's sewer fund balance. To eliminate a deficit in the sewer fund, a loan of $450,000 from the water fund will be necessary. The water fund is currently healthy and can absorb a five year loan to the sewer fund.  The loan will be considered on a subsequent agenda.

Any change in water and sewer fees is subject to Proposition 218 which requires the CSA to hold a public protest hearing prior to adopting the proposed fee changes. If more than 50% of the affected property owners submit written protests against the proposed fee increase, the increase cannot be adopted.  Notice of the hearing will be mailed to residents no later than May 11. On June 6, a CSA Advisory Committee meeting will be held at 6:30 p.m at The Nest at the Wild Wings Golf Course to provide the community information about the updated Engineer's Fee Report and fee increases, and to answer questions from residents.
