Accept Parcel Map No. 5096 to create one parcel of approximately 141 acres ("Parcel 1"), and leave a remainder (not surveyed) of approximately 977 acres, from an existing 1,118-acre agriculturally-zoned farming property in order to facilitate the sale of Parcel 1 to a party with an interest in planting tree crops (walnuts). The property is located east of County Road (CR) 104 (Mace Boulevard), south of the City of Davis, and borders the northern edge of the south fork of Putah Creek. Recommended Action
  1. Adopt the attached Resolution of Acceptance of Parcel Map No. 5096 for Los Rios Farms (Attachment B);
     
  2. Instruct the Clerk of the Board of Supervisors to verify that the Tax Collector has signed the map;
     
  3. Authorize the Clerk of the Board of Supervisors to sign and transmit Parcel Map No. 5096 (Attachment C) to the County Clerk-Recorder for filing; and
     
  4. Approve a Williamson Act contract division of Land Use Agreement #72-069, and authorize the Chair to sign a new Williamson Act Successor Agreement for the newly created Parcel 1 (Attachment E).

Reason for Recommended Action/Background
On November 12, 2015, the Planning Commission approved a Tentative Parcel Map request from an applicant to separate approximately 141 acres (proposed "Parcel 1") of farmland from a 1,118-acre agriculturally-zoned parcel in order to facilitate a sale. The applicant has satisfied all conditions of approval placed on Tentative Parcel Map #5096 by the Planning Commission and has submitted the final Parcel Map for acceptance by the Board of Supervisors. Approval of the Parcel Map will allow the current property owner (Los Rios Farms) to sell Parcel 1 to an interested party who plans to plant the property with walnut tree crops. The approximately 977 remaining acres will continue under current ownership. No new development has been proposed as part of this Parcel Map.

Background

The property is located east of County Road (CR) 104 (Mace Boulevard), south of the City of Davis, and borders the northern edge of the south fork of Putah Creek. The 1,118-acre property consists of several Assessor's Parcel Numbers (APNs) that make up Los Rios Farms, whose current configuration is the result of Parcel Map No. 2869 that was recorded in 1978 for Anderson Farms. The property, along with several other adjoining parcels, is under the Williamson Act. Additionally, a majority of Los Rios Farms, excluding the proposed Parcel 1, is under a conservation easement that is held jointly by the City of Davis and the Yolo Land Trust, and is permanently conserved for its open space and agricultural values. A separate Williamson Act Successor Agreement has been prepared for the newly created Parcel 1 (Attachment E).

Parcel 1, which is currently identified by a separate Assessor's Parcel Number (APN: 033-110-042), will maintain access off of CR 104. The remainder parcel will gain access via a dedicated easement along Parcel 1's western and northern boundaries. Los Rios Farms is currently served by groundwater and surface water under a recorded water agreement (the Mace Ranch Irrigation System, Grant of Easements and Water Delivery Agreement). Although the agreement runs with the land, it is expected that once under new ownership, a new well will be constructed on Parcel 1 to serve the permanent tree crop. There are currently no improvements on the proposed Parcel 1. As specified in the project's Conditions of Approval, any future residential development on Parcel 1 will be required to mitigate for the loss of Swainson's hawk foraging habitat (Attachment D).

As described in the November 12, 2015, Planning Commission staff report, the purpose of the map is to facilitate the sale of Parcel 1, which would allow a new owner to intensify agricultural productivity by converting to high-value permanent crops (walnuts). The Planning Commission approved Tentative Parcel Map No. 5096 to separate approximately 141 acres from Los Rios Farms. Parcel Map No. 5096 was submitted to the County Surveyor for a first review on December 15, 2015, and deemed to be a timely filing of the Parcel Map for review and processing purposes under Section 66463.5(b) of the State Subdivision Map Act. The conditions of approval relating to approved Tentative Parcel Map No. 5096 have been satisfied. The recommended actions are necessary prior to filing Parcel Map No. 5096 with the County Clerk-Recorder.

Pursuant to Section 15286 of the California Environmental Quality Act (CEQA) Guidelines, the approval of final maps is exempt from the requirements of CEQA as a ministerial project.
Collaborations (including Board advisory groups and external partner agencies)
The Planning Commission approved the Tentative Parcel Map on November 12, 2015. The project was routed to the City of Davis for review under the Pass-Through Agreement, but the City declined to comment. The Office of the County Counsel has reviewed and approved the Parcel Map Acceptance Resolution and Williamson Act Successor Agreement as to form.
