Reason for Recommended Action/Background
As set forth in the June 29, 2021, staff report for the introduction of this ordinance (Item #12), SB 678 (chaptered on October 11, 2009) established a program to reduce the percentage of adult probationers sent to prison for probation failure.  This bill added Penal Code section 1230, which established the Community Corrections Partnership (CCP), as an advisory body to Probation. The County established its CCP shortly thereafter.
 
Two years later, the Legislature adopted the Public Safety Realignment Act of 2011.  Among other things, the Act requires each local CCP to prepare and recommend a public safety realignment plan (CCP Strategic Plan) to the county Board of Supervisors “to maximize the effective investment of criminal justice resources in evidence-based correctional sanctions and programs[.]”  The Act also established an Executive Committee of the local partnership as the voting authority within the CCP for the Strategic Plan.

The proposed ordinance will not affect the composition of the Executive Committee, but would instead increase representation of the Health and Human Services Agency (HHSA) on the broader CCP.  The ordinance would achieve this by modifying provisions of the Yolo County Code to state that the consolidation of various statutory roles with the HHSA Director position shall not be considered for purposes of CCP participation.  In effect, this change would allow the HHSA branch directors responsible for certain functions (substance abuse and employment) to each occupy a seat on the CCP, with the HHSA Director maintaining their seat as the representative of two functions (social services and mental health) also accorded representation on the CCP by state law.  

This Office recommends the ordinance as the best approach to achieving CCP representation that reflects the intentions of the Legislature.  The ordinance is supported by Supervisors Saylor and Provenza (the Board's representatives to the CCP) as well as Chief Fruchtenict and HHSA Director Karen Larsen.
