Recommended Action
  1. Hold a public hearing to consider a request to vacate a portion of County Road 100B; 
     
  2. Determine that the project is exempt from the California Environmental Quality Act (CEQA) and CEQA Guidelines and direct staff to file a Notice of Exemption;
     
  3. Adopt a resolution to vacate a portion of County Road 100B on Assessor’s Parcel Numbers 027-250-005 and 027-250-006 and associated conditions of approval; and
     
  4. Authorize the Clerk of the Board of Supervisors to record a certified copy of the adopted resolution in accordance with the terms of the resolution.

BACKGROUND
 
Clark Pacific submitted a complete application on October 26, 2020, requesting the vacation of a portion of County Road (CR) 100B. The portion of road proposed for vacation contains a portion of right-of-way that totals 3.79 acres and extends about 2500 feet north from County Road 18C up to County Road 18A (aka Best Ranch Road). See Attachment A for a location map depicting the location, which is just north of the City of Woodland.
 
The right-of-way was originally conveyed, by Deed, as a strip of land from Spreckles Sugar to the County in 1935, recorded in Book 113 of Official Records at pages 264-265, Yolo County Clerk Recorder. Currently there are two parcels directly accessed by the proposed vacation which are both owned by Clark Pacific. The Planning Commission’s review on January 21, 2021 under Government Code Section 65402, as required by Streets and Highways Code Section 8313, resulted in a determination that the request was not in conflict with or did not apply to the General Plan (Attachment B).
 
Staff has concluded that this action is exempt from the California Environmental Quality Act (CEQA) (Attachment C). Section 15305 Class 5 of the CEQA Guidelines allows for a lead agency to determine whether a project is exempt from CEQA if it consists of minor alterations in land use limitations in areas with an average slope of less than 20%, which do not result in any changes in land use or density. Further, the project qualifies for the “common sense” exemption of CEQA Guidelines Section 15061(b)(3) because it can be seen with certainty that there is no possibility that a project may have a significant effect on the environment.
 
Pursuant to Streets and Highways Code Section 8320, the Board of Supervisors initiated the road vacation proceedings on February 9, 2021 and encouraged the applicant and the residents to negotiate a resolution regarding the issue of access brought forward by residents during public comment.
 
REASON FOR RECOMMENDED ACTIONS
 
Clark Pacific submitted for the CR100B road vacation to improve safety and efficiency of the operations at its concrete manufacturing plant which is bisected by the portion of road being considered for vacation.  The western side of the plant includes pouring and welding facilities, and sandblasting and painting areas that are used to manufacture large concrete panels.  The eastern side of the plant is used as a curing site for storing and drying the panels and includes a solar field and hazardous waste facility. Large mobile construction cranes are used regularly to transport the heavy concrete panels from the western side of the plant to the eastern side of the plant, requiring frequent road closures, which cause safety and security issues and result in significant operational inefficiencies.
 
During the Board meeting on February 9, 2021 when the vacation was initiated, several residents voiced concern about closing the road because CR 100B provides critical access for farm equipment. These concerns were responded to by the applicant through negotiations over a private access easement roughly 2000 ft to the west of CR 100B with the effected land owners.  The applicant is proposing to offer an easement for a 20 ft wide paved road on its property to the west of the plant.  The easement document has been reviewed by County Counsel and provided to the affected property owners, who will have 60 days to accept.
 
Given the applicant’s progress to preserve access for the residents affected and in accordance with the Streets and Highways Code Section 8320, staff recommends the Board adopt a resolution (Attachment D) to vacate a portion of County Road 100B on Assessor’s Parcel Numbers 027-250-005 and 027-250-006.  The resolution will be recorded within ninety days from the date of this signed resolution, or as soon as the conditions for the replacement easement are completed, whichever is later.
