Recommended Action
  1. Adopt the plans and specifications for construction of the CR 40 Bridge over Cache Creek Replacement Project (on file with the Clerk of the Board);
     
  2. Authorize the Director of Public Works to sign the Notice to Contractors;
     
  3. Authorize the Department of Community Services to advertise for competitive bids;
     
  4. Authorize the Director of Public Works to execute a construction contract with the lowest responsive bidder, provided the contract amount does not exceed budgeted funds, or to reject all bids;
     
  5. Authorize the Director of Public Works to approve all construction change orders, provided the contract amount does not exceed budgeted funds for the project; and
     
  6. Adopt a resolution of acceptance of a segment of County Road 40 into the County’s maintained mileage and authorize the Chair of the Board of Supervisors to sign the resolution.

BACKGROUND
 
The CR40 Bridge over Cache Creek (aka Low Water Bridge) is in northwestern Yolo County, near the intersection of County Road 40 and State Route 16, approximately 5 miles northwest of the town of Rumsey. The bridge is within the Cache Creek Regional Park’s Lower Site. The existing six-cell reinforced concrete box culvert bridge was determined to be structurally deficient with a safe load capacity designated at zero tons and was closed to vehicular traffic in 2008.
 
When a portion of the Rumsey area burned in the 2015 Rocky Fire, CalFire could not use the current CR40 bridge for its heavy equipment to access fire lines and instead had to build a temporary crossing over Cache Creek. Most recently in the 2020 LNU Complex Fire, the National Guard was mobilized to install a temporary bridge just upstream of the failed low water crossing, so CalFire could fight the wildfire in the wilderness area west of Cache Creek.
 
In order to accelerate replacement of the bridge, the County received an $800,000 grant from CalFire in 2018 to fund the preliminary engineering and environmental phases of the project.
 
The replacement bridge will be a three-span, cast-in-place, reinforced concrete slab superstructure supported on two-column pile extension bents and seat type abutments, founded on 30-inch cast-in-drilled-hole concrete piles.  The replacement bridge will be constructed on an improved alignment at essentially the same location as the existing bridge. The bridge will provide a minimum clear width of 20-feet, the same as the existing structure. The structure will be constructed with a horizontal curve radius of 132-feet, to accommodate CalFire’s 72-foot long tractor and trailer vehicle used to transport their firefighting equipment across Cache Creek.  The proposed bridge will also provide enough vertical clearance for recreational rafters to pass underneath it during summer irrigation creek flows.
 
The CEQA mitigated negative declaration for this project was approved on November 17, 2020. The NEPA categorical exclusion was approved on January 11, 2021. In addition, County staff and Yocha Dehe Wintun Nation staff collaborated early in the design and environmental phases of the project to ensure an acceptable design and bridge alignment in relation to cultural resources previously identified in the area of the project.
 
To further accelerate replacement of this bridge, CalFire will provide $2,200,000 in State funds for construction phase activities necessary to replace the bridge.  Assemblymember Aguiar-Curry was instrumental in originally setting aside these funds in the State’s Fiscal Year 19/20 Budget for assisting in prioritizing the CR40 bridge replacement project. Due to an approximate one-year delay in the environmental phase approval, the project construction had to be moved ahead a year. The County Administrator’s Office staff was able to coordinate with CalFire to successfully re-appropriate the funds for the following fiscal year, as well. A funding agreement is being drafted by CalFire and is anticipated to go before the Board ahead of the construction contract award.
 
The project construction cost is estimated at $3,480,000. The balance of construction phase funds are planned to be reimbursed by the federal Highway Bridge Fund (HBP). A request for authorization to proceed with construction was submitted to Caltrans on March 22, 2021. The bridge is programmed for HBP construction reimbursement for up to $4,278,000. With CalFire’s contribution of construction funds, the county will not need to request the full amount programmed in the HBP. The HBP, however, is significantly underfunded and no federal funds have been allocated towards the project to date for construction. County staff proposes to move the project forward using the Road Fund under a Caltrans agreement for delayed reimbursement from the HBP. Staff has been informed that the reimbursement could be distributed the following fiscal year or later, and the agreement cautions reimbursement is not guaranteed. Being that this bridge is a safety replacement priority, County staff recommends proceeding with the project in order to preserve the CalFire funding.
 
The project will take approximately 190 working days to complete. Work within the creek is expected to be completed in 2021. Any remaining work outside of the creek may need to be completed in early 2022, if necessary.
 
The bridge is currently closed and will remain closed for the duration of construction. County staff have been coordinating with the Parks Division and with some of the local rafting companies for advanced notification of the project and the potential impacts to their normal operations.

The engineer’s estimate for construction is $3,480,000.  The estimate for construction engineering is $520,000.  Sufficient funds were included in the FY2021/22 Road Fund budget.  The total cost will be reimbursed by State funds through the CalFire grant funds and federal transportation funds (HBP) at a rate of 100%.  The Caltrans agreement cautions reimbursement through the HBP is not guaranteed.  If Public Works does not receive HBP funds, then the project will be reimbursed at a rate of 55%.
