Recommended Action
  1. Approve first amendment to Agreement No.19-144 with Yolo Community Care Continuum (YCCC) for the Farmhouse Program to add Mental Health Services Act (MHSA) funding in the amount of $10,000 for fiscal year (FY) 2019-20, for a new contract maximum of $1,411,60 for the period July 1, 2020 through June 30, 2022; add a new rate beginning FY2020-21, and revise and clarify contract language; and
     
  2. Increase the delegated authority for the HHSA Director to exercise and issue related optional year notices granted with the approval of Agreement No. 19-144 by the $10,000 increase noted in A., above for a maximum for a 5-year maximum payment obligation not to exceed $2,346,000.

Reason for Recommended Action/Background
Yolo County serves Seriously Mentally Ill adults meeting the mental health medical necessity criteria consumers that require the long-term residential treatment services provided by the YCCC Farmhouse Program.  The goals of this program are to help clients increase their ability to live independently through skill building, job training and/or other educational programs to further their independence and reducing costs to the County by reducing psychiatric hospital stays, Institute for Mental Disease (IMD) placements, and homelessness. Approval of this amendment adds $10,000 to fiscal year 2019-20 so pending claims can be paid, adds a new daily rate beginning FY 2020-21, and revises and clarifies contract language to align with State contract requirements for Mental Health Service Act (MHSA) funded agreements.
 
Further, when Agreement 19-144 was approved by this Board, delegated authority was granted to the HHSA Director or her/his designee to exercise the optional extensions and approve option year notices as follows: $467,200 per fiscal year, for fiscal years 2022-23 and 2023-24 for a 5-year maximum payment obligation not to exceed $2,336,000.

With the addition of the $10,000 to FY 2019-20, the total contract maximum after all maximum optional extensions will increase from $2,336,000 to $2,346,000 (Please see Section 1 of Att. A. Amendment, amending Section III(B)(2) of Agreement 19-144.) Thus, staff requests the delegated authority to the HHSA Director include this the $10,000 increase.
 
For above reason, staff recommends the approval of this first amendment to Agreement 19-144.

Competitive Bid Process
Previously these services were procured under the any willing provider exception delegated by the BOS on July 31, 2007, which granted an approval to the Department of Alcohol, Drug, and Mental Health for certain exceptions to the contract procurement policy. At that time 24 hour residential services providers were classified as “Any Willing Provider” and were exempt from the competitive bid process.
 
On or about March 20, 2018, the BOS approved a new Yolo County procurement policy via Minute Order No. 18-55, Item No. 32, effective July 1, 2018, which rescinded all previous exceptions to the competitive selection process. 
 
On or about January 30, 2019, the Yolo County Procurement Manager approved a sole source letter in conformance with the updated Yolo County Procurement Policy.

No general funds are required by this action.  These services will be funded by State Realignment and Mental Health Service Act (MHSA) funds. The amount of $477,200 is included in the HHSA adopted budget for FY 2019-20. The related funding will be included in the requested budget process for future fiscal years.

The agreement also includes the option for 2 additional one-year extensions for fiscal years 2022-23 and 2023-24, in an amount less than or equal to $467,200 per fiscal year.
 
In no event shall the term of the agreement extend beyond June 30, 2024 nor shall the total contract maximum exceed, including the 2 one-year extension options, exceed the amount of $ 2,346,000 unless otherwise agreed to in writing by the parties and in conformity with the Yolo County Procurement Policy.
