Recommended Action
  1. Hold public hearing regarding the establishment of the Yolo County Tourism Business Improvement District;
     
  2. Adopt resolution declaring results of majority protest proceedings and establishing the Yolo County Tourism Business Improvement District; and
     
  3. Approve contract with Yolo County Visitor's Bureau regarding a Tourism Business Improvement District assessment pass-through and related responsibilities and waive the administrative fee associated with collecting and processing assessments.

Reason for Recommended Action/Background
On May 9, 2017 the Board adopted a resolution of intention to establish the Yolo County Tourism Business Improvement District (District). The District is a benefit assessment district to fund marketing and public relations and community marketing programs for unincorporated Yolo County and the cities of Davis, Winters and Woodland lodging businesses. The annual assessment rate shall be two percent (2%) of gross room rental revenue. This approach has been used successfully in other destination areas throughout the state to improve tourism and drive additional room nights. The proposed District includes all lodging businesses located within the boundaries of unincorporated Yolo County and the cities of Davis, Winters and Woodland.

Pursuant to Government Code section 54954.6, the Board held a public meeting on June 6, 2017 to allow for public testimony on the formation of the District and levy of assessments. There was no public testimony at the meeting. Separately, staff has received one protest (Att A), however, this protest does not meet the threshold of "majority protest" defined as written protests received from owners of businesses in the proposed District which would pay fifty percent (50%) or more of the assessments. As such, staff recommends the Board adopt the Resolution of Formation (Att B). If adopted, the new District and assessment will take effect July 1, 2017. Additionally, staff is recommending the Board waive the administrative fee associated with collecting and processing of assessments as currently staff does not charge an administrative fee for the collection of Transient Occupancy Tax and the additional work associated with now collecting this additional assessment is de minimis. Furthermore, other jurisdictions within the District are similarly not charging an administrative fee.
