- Waive second reading and adopt an ordinance amending zoning for 13 parcels to add the Sand and Gravel Reserve Overlay (SGRO) zone (Attachment B).

Reason for Recommended Action/Background |
The Cache Creek Area Plan (CCAP) is a rivershed management plan that sets policy for and regulates off-channel surface mining along, as well as in-channel restoration and maintenance within, Lower Cache Creek. The program is based on the concept of adaptive management, and relies on ongoing detailed monitoring, analysis, and reevaluation. A comprehensive ten-year review is mandatory under the program. The CCAP Update constitutes the second mandatory ten-year program review since the program was put into effect in 1996. The purpose of the Update is to analyze trends and adjust the program to avoid unexpected effects on Cache Creek resources focusing on:
- Changes in creek conditions
- Analysis of collected data
- New regulatory requirements
The proposed Update has undergone extensive public, industry, and agency review. The proposed actions improve and modernize an important, stable, well-run program that enjoys extensive support from various stakeholders, and remains "state-of-the-art" after 22 years of implementation.
At their meeting on December 17, 2019, the Yolo County Board of Supervisors unanimously approved six recommended actions from Staff pertaining to the CCAP Update. The actions are listed in Minute Order No. 19-163 (Attachment C). Two of the actions involve the adoption of ordinances, which require a second reading before going into effect.
The first ordinance involves amending the several ordinances that implement that CCAP, in accordance with the CCAP Update. The ordinances being amended are the following:
- Title 8, Chapter 4, Flood Protection Ordinance
- Title 10, Chapter 3, Cache Creek In-Channel Maintenance Mining Ordinance
- Title 10, Chapter 4, Off-Channel Surface Mining Ordinance
- Title 10, Chapter 5, Surface Mining and Reclamation Ordinance
- Title 10, Chapter 11, Gravel Mining Fee Ordinance
The specific edits to these ordinances can be found within Attachment A's Exhibits 1 through 5.
The second ordinance involves the rezoning of 13 parcels within the CCAP's planning area. Specifically, the ordinance will add the Sand and Gravel Reserve Overlay (SGRO) zone to all, or a portion of, the underlying Agricultural-Intensive (A-N) base zone of the parcels. The SGRO identifies land for which there are known important aggregate deposits. Future mining may be allowed on these parcels; however, these future mining activities are subject to application, processing, review, and approval. The properties affected by the rezoning ordinance include the following parcels, identified by Assessor's Parcel Numbers (APNs):

Throughout the CCAP Update process, staff collaborated with the public and landowners who live within the CCAP's programmatic boundaries, the Yolo Producers Working Group of the California Construction and Industrial Materials Association (CalCIMA), the Yolo County Flood Control District, the Cache Creek Conservancy, the Yolo County Department of Community Services and the Office of County Counsel, as well as the various local, state, and federal agencies with regulatory involvement with the CCAP. |
