Recommended Action
  1. Adopt a resolution to summarily vacate a portion of County Road 76 on Assessor’s Parcel Numbers 048-230-004, 048-230-002 and 060-020-020, and
     
  2. Authorize the Clerk of the Board of Supervisors to record a certified copy of the adopted resolution.

Reason for Recommended Action/Background
A complete application requesting the vacation of a portion of County Road 76 was submitted on behalf of the Yocha Dehe Wintun Nation on August 20, 2018 and was reviewed by the Planning Division. The portion of road proposed for vacation is a 15-foot wide right-of-way, and extends about 2,615 feet west from State Route 16. See Attachment A for an aerial view depicting the location, which is approximately two miles northwest of Esparto.
 
The 15-foot right-of-way was originally offered for dedication to Yolo County within the Map of Tancred Subdivision, recorded in the Yolo County Records as Map Book 2, Page 42, with map and highways approved by the Board of Supervisors on August 12, 1911 (L-365, Supervisor Minutes). Currently there are four parcels affected by the proposed vacation which are all owned by the Yocha Dehe Wintun Nation. Per the California Streets and Highways Code Section 8334, the Board of Supervisors can summarily vacate the road, meaning it does not need to go through the general vacation procedure, due to "a portion of a street or highway that lies within property under one ownership and that does not continue through such ownership or end touching property of another.” See Attachment B for the resolution to vacate this road right-of-way.
