Adopt budget resolution increasing the District Attorney's Asset Forfeiture 2018-19 recommended budget by $17,000 to purchase a GrayKey unit and annual license for the DA's High-Tech Crimes Unit. (No general fund impact) (Reisig)
Recommended Action
  1. Adopt budget resolution increasing the District Attorney's fiscal year 2018-19 recommended budget by $17,000; and
     
  2. Approve the purchase of a GrayKey unit and annual license for the DA's High-Tech Crimes Unit, as this software was not included on the equipment list when recommended budget was approved.

Reason for Recommended Action/Background
It has become increasingly difficult for the District Attorney's High-Tech Crimes Unit to extract digital evidence from iPhones.  Over the past three fiscal years, the High-Tech unit has received an increase in evidence request dealing with iPhones.  In FY 15/16, 15% of the cell phones received were iPhone and in FY 17/18, 33% of the cell phones received were iPhones.   

Currently the DA High-Tech Crimes Unit is using Cellebrite to extract evidence from cell phones.  This system is inadequate in extracting evidence from the newer iPhones.  This is why is it necessary for the District Attorney's office to purchase the GrayKey software from Grayshift.  This software will allow the High-Tech Crimes Unit to extract evidence from all iPhones, even from the new models, the iPhone 8 and X. 

Grayshift is a sole proprietor of the GrayKey software and the sole source request has been approved by the Purchasing Manager.  To maintain this software, there will be an annual $15,000 fee.  This cost will be covered annually by seized assets.

With the purchase of the GrayKey software, the DA will be collaborating with all the local law enforcement agencies.

County Counsel has reviewed the budget resolution and approved to form.  Department of Financial Services has reviewed the budget resolution and approved.  The purchasing manager has reviewed and approved the request for sole source.

With the purchase of the GrayKey software, the District Attorney's office will have an ongoing annual licensing fee of $15,000.  The District Attorney's Seized Assets budget will cover these annual cost.  No general funds will be needed.
