Reason for Recommended Action/Background
On March 24, 2022, the Board of Supervisors approved a five-year agreement between NICE Systems and the District Attorney's office for a max cost of $959,673.

The NICE Justice software allows the DA to uniform their process for collecting and distributing discovery to the defense in a timely downloadable format, standardizing video from any media source and/or format, and transcribe any video/audio discovery with 90% accuracy.

Since going live with NICE Justice, we have on-boarded several of our law enforcement agencies to receive digital evidence directly.  We have started sending digital discovery directly to the Public Defender's Office, and we are in the process of including the Conflict Panel.

When we established the initial contract, there were several features that were unavailable, such as, offering unlimited storage, transcriptions, and redactions.  These features are now available, allowing us to amend the agreement to include these features and lower our subscription cost for year two to year five.

The amendment to Agreement No. 22-98 will create a reduction of $223,653. This is a five-year agreement.  In fiscal year 2023-24, we budgeted $181,653 for this agreement but will only be paying $99,750 once the amendment is approved. This is a reduction of $81,903. NICE Justice is funded through the use of Calmmet funds.  Any savings in that fund reverts to fund balance for reappropriation in future fiscal years.
