Adopt a resolution authorizing the Agricultural Commissioner/Sealer of Weights and Measures to execute revenue agreements for a net total of $228,558 with the California Department of Agriculture, $138,000 with the California Department of Transportation, $10,810 with the California Crop Improvement Association, $9,118 with the California Rice Commission, $8,024 with the California Agricultural Commissioners and Sealers Association and $23,994 with the California Department of Pesticide Regulation; and authorize the Agricultural Commissioner/Sealer of Weights and Measures to execute revenue contract amendments up to 15% over the approved contract amounts. (No general fund impact) (Young)
Recommended Action
  1. Adopt a resolution authorizing John Young, Yolo County Agricultural Commissioner/Sealer of Weights and Measures, to sign revenue agreements for fiscal year 2015/16 and fiscal year 2016/17; and
     
  2. Authorize the Yolo County Agricultural Commissioner/Sealer of Weights and Measures to execute any revenue contract amendments, up to 15% over the approved amounts, to these agreements on behalf of Yolo County.

Reason for Recommended Action/Background
Summary:

Agreements and contracts with the California Department of Agriculture, the California Department of Transportation, the California Crop Improvement Association, the California Rice Commission, The California Department of Pesticide Regulation and the California Agricultural Commissioners and Sealers Association entered into by the Yolo County Agricultural Commissioner/Sealer of Weights and Measures must be signed by the Chair of the Board or an authorized designee. Authorizing the Agricultural Commissioner/Sealer of Weights and Measures to sign these agreements allows the contracts to be processed in a more efficient and cost effective manner. It should be noted that Solano County adopted the proposed method of contract approval several years ago.

Discussion:

The Agricultural Commissioner/Sealer of Weights and Measures receives funding through state agencies, fees and other contractual agreements to offset County costs. A major source of funding for agriculture and weights and measures programs is State of California agreements. To obtain the revenue Yolo County enters into agreements with various State agencies on an annual basis. These agreements are initially prepared by the State agency and then sent to the County for approval at various times throughout the year.

Listed below are the revenue agreements and anticipated annual funding:

1. California Rice Commission Rice Pesticide Program: FY 2015/16 includes $9,118, for increased surveillance of rice pesticide application and water holds to mitigate and eliminate impact to the waters of California.

2. Caltrans Weed and Vertebrate Program: is a two year agreement totaling $138,000 and covers FY2015/16 and FY2016/17 for the management of noxious weeds and burrowing rodents on Caltrans rights of ways within Yolo County.

3. California Agricultural Commissioners and Sealers Association Pesticide Use Report Data Entry Agreement: FY2015/16 includes $8,024, for the entry of pesticide use reports. Pesticide use reporting is required from a variety of users. Originally placed into law for food safety, the data is used for analysis of pesticide use in a variety of situations. From household use to potential water impacts. The funding is provided for manual entry of hand written use reports. Growers and other users are being encouraged through outreach to move to online reporting.

4. California Department of Agriculture Pest Detection Agreement: FY2015/16 includes $38,613 for insect trapping. This is a statewide program to detect insect pests of economic concern before they become established in California. Target pests include: the Mediterranean Fruit Fly, Japanese Beetle, Gypsy Moth and others. Insect traps are placed throughout Yolo County from May to October to detect these pests. Revenue from this contract supports the deployment of the traps, regular inspection by agricultural staff and submission of samples to CDFA.

5. California Department of Agriculture Glassy wing Sharpshooter Agreement: is a two year agreement totaling $42,046 and covers FY2015/16 and FY2016/17 for the Glassy wing Sharpshooter (GWSS) program. GWSS is a leaf hopper that feeds primarily on plant sap and is established in Central and Southern California. A statewide management program has been established to prevent spread of GWSS and is supported by the grape industry through a self-assessment program. Funds from this assessment are provided to the county through a CDFA contract. In Yolo County this contract supports inspection, detection and enforcement programs.

6. California Department of Agriculture Pest Exclusion: High-Risk Inspection Agreement: FY2015/16 includes $9,400 for inspection of high risk shipments, such as fruit or foliage, at ground and air freight facilities, to prevent introduction of pests of concern to California.

7. California Department of Agriculture Pest Exclusion: Dog Team Agreement: FY2015/16 includes $92,000 for the inspection of packages profiled by the Sacramento County Dog Team at the United State Postal Services Sectional Center in West Sacramento. The profiled packages contain plant material that is shipped into California from other states that have established populations of invasive pests.

8. California Department of Agriculture Light Brown Apple Moth – Detection Agreement: FY2015/16 includes $2,670 for Light Brown Apple Moth traps to be included along with our general Pest Detection traps.

9. California Department of Agriculture Light Brown Apple Moth – Regulatory Agreement: FY2015/16 includes $9,500 for Light Brown Apple Moth regulatory compliance inspections for the Light Brown Apple Moth infested area of Yolo County to allow the shipment of agricultural commodities.

10. California Department of Agriculture Nursery Inspection Program Agreement: FY2015/16 includes $500 for annual nursery stock inspection and compliance assessment at producer/wholesale nursery locations within the county.

11. California Department of Agriculture Organic Registration Program Agreement: FY2015/16 includes $720 to process CDFA organic registration application.

12. California Department of Agriculture Petroleum Products Enforcement Agreement: FY2015/16 includes $3,975 for inspections. Inspections are conducted at retail fuel establishments throughout Yolo County to confirm that pricing signs and advertising are in compliance with regulatory standards.

13. California Department of Agriculture Seed Services Agreement: FY2015/16 includes $5,353 for regulatory inspections of Yolo County seed processors.

14. California Department of Agriculture Standardization Inspection Program Agreement: FY2015/16 includes $19,941 for the inspection of melons produced in Yolo County to assure regulatory compliance.

15. California Department of Agriculture Weighmaster Enforcement Program Agreement: FY2015/16 includes $3,840 for the inspections of licensed junk dealers that purchase scrap metals. Inspections are conducted to verify compliance with applicable laws and regulations.

16. Seed Certification Program: FY2015/16 includes $10,810 for the inspection of harvest operations to maintain the quality of certified seed produced in Yolo County on behalf of the California Crop Improvement Association.

17. California Department of Pesticide Regulations Enforcement Evaluation and Improvement Project Agreement: FY2015/16 includes $23,994 to provide assistance to the California Department of Pesticide Regulation in carrying out its enforcement evaluation and improvement project by collecting data, ensuring the consistent application of statewide DPR policies, laws and regulations and the tracking, development and preparation of enforcement response as needed.

Executed agreements will be placed on file with the Clerk of the Board.
Collaborations (including Board advisory groups and external partner agencies)
County Counsel reviews and approves all agreements as to form before they are executed by the Agricultural Commissioner/Sealer of Weights and Measures. The County Administrator's Office has reviewed this proposal and concurs with the recommendation. The California Department of Food and Agriculture, the California Department of Pesticide Regulation, Solano County and the California Agricultural Commissioners and Sealers Association support this procedure for obtaining County approval for contracts and agreements.
