Recommended Action
  1. Accept as complete the first phase of construction work at Waste Management Unit 6F constructed by RJ Gordon Construction, Inc. (RJ Gordon); and
     
  2. Authorize the Director of Community Services to sign and record the Notice of Completion for Phase 1 and release retention in the amount of $324,026.

Reason for Recommended Action/Background
On April 23, 2019 the Board approved the agreement with RJ Gordon Construction Inc. for construction of the landfill's next waste management unit, denoted WMU 6F.  Construction began on May 13, 2019 and progressed throughout the spring, summer and fall.  Throughout the course of the project, construction crews worked up to 6 days per week and 12 hours per day to move the 500,000 cubic yards of soil and install the 1.9 million square feet of geomembrane (thick plastic) liner necessary to construct a modern landfill module.

Construction of all new landfill modules must be inspected by an independent, third party, construction quality assurance (CQA) firm who is tasked to ensure the project is constructed in accordance with the plans and specifications and must complete a certification report to be submitted to the California Regional Water Quality Control Board (Water Board).  Water Board approval of this certification report is necessary prior to placing waste in the module.   For this module, the County retained Golder Associates as the CQA firm.  The CQA report for Phase 1 was completed and submitted to the Water Board on December 6, 2019 and approval of this report and authorization to place waste in Phase 1 of WMU6F was received on January 24, 2020.  The County began placing waste in the Phase 1 area on January 27, 2020.

The plans and specifications for WMU 6F provided for a phased project, whereby the contractor had 130 working days to complete Phase 1 of the project and an additional 60 working days to complete Phase 2.  This was done because of the size of the project and to ensure a portion of the module would be available for waste placement prior to the landfill running out of available space.  RJ Gordon was able to complete Phase 1 in the allowable working days and completed most of Phase 2 prior to wet weather shutting down construction in late November.  Following completion of Phase 1, the County received a request from RJ Gordon to release their retention associated with this phase of the project.

The specifications for the project do not specifically mention a phased acceptance and release of retention so County staff coordinated with County Counsel as well as their outside legal expert.   Based on this consultation, a phased acceptance and release of retention was possible, provided the County receive approval from RJ Gordon’s surety as well as releases from its subcontractors and suppliers. These precautions were required to minimize the risk to the County.  RJ Gordon has provided the necessary approvals and releases.

The total contract amount, including approved change orders for WMU 6F is $9,258,446.  The Phase 1 area represents approximately 70 percent of the project, or $6,480,912.  On construction projects, 5 percent of each payment to the contractor is withheld as retention, therefore the retention associated with Phase 1 was calculated at $324,046 and this amount would be released upon approval of this action.  Currently, the county is retaining $447,036 for the whole project, therefore $122,990 would still be withheld to ensure completion of Phase 2.  Recent dry weather in February has allowed work to resume on Phase 2, with the vast majority of work now complete.
