Adopt budget resolution to appropriate funds for the Yolo Conflict Resolution Center to provide dispute resolution services in accordance with the Dispute Resolutions Programs Act of 1986 (DRPA), Business and Professions Code Section 465-471.5, and the regulations set forth in Title 16 of the California Code of Regulations, Chapter 36, including assisting in the creation of a state-wide system of locally-funded programs which will provide dispute resolution services (primarily conciliation and mediation) to county residents. Recommended Action

Reason for Recommended Action/Background
The Dispute Resolution Programs Act of 1986 (DRPA) and its Regulations established funding for local alternative dispute resolution programs. The purpose of the Act is the creation of a statewide system of locally funded programs that provide dispute resolution services (primarily conciliation and mediation) to county residents, with the goal of delivering effective and efficient services to assist people in resolving problems outside of the formal justice system.

With adequate funding in the Dispute Resolution Program fund to re-establish a local alternative dispute resolution program in Yolo County, staff released a request for proposal for dispute resolution services in 2014 and selected the Yolo Conflict Resolution Center (YCRC). YCRC is an experienced dispute resolution service provider and plans to outreach and service all of Yolo County, including residents in the cities of Davis, West Sacramento, Winters, Woodland, as well as the unincorporated areas. Dispute resolution services will be provided for cases such as:
  • Roommate disagreements;
  • Landlord/tenant issues: Claims regarding rent, security deposit, and cleaning fees;
  • Ongoing neighborhood conflicts regarding noise, landscaping, and parking;
  • Disputes between merchants and customers;
  • Disputes between businesses;
  • Conflicts within community groups and organizations; and
  • Family conflicts.
Over the next 15 months, members of the DRPA Committee will evaluate YCRC's delivery of such services in Yolo County and provide the necessary annual reports to the California Department of Consumer Affairs.  

This agenda item authorizes $32,000 of Dispute Resolution Program Funds to the Yolo Conflict Resolution Center to cover startup costs and begin program service on April 1, 2015 for the remainder of the fiscal year.  The funds will enable YCRC to provide dispute resolution services in accordance with the Dispute Resolutions Programs Act of 1986 (DRPA), Business and Professions Code Section 465-471.5, and the regulations set forth in Title 16 of the California Code of Regulations, Chapter 36, including assisting in the creation of a state-wide system of locally-funded programs which will provide dispute resolution services (primarily conciliation and mediation) to county residents.

The remaining $48,000 balance of YCRC's 15 month contract, which will cover July 1, 2015 to June 30, 2016, will be part of the FY 15-16 Recommended Budget.

There is no general fund impact.  The DRPA funding comes from filing fees in superior, municipal, and justice court actions.  The current fiscal year amount being requested is $32,000.  The remaining contract amount ($48,000) will be requested as part of the FY 15-16 Recommended Budget process.
