Approve the Workforce Investment Board's application for the initial designation as the Local Workforce Development Area and certification of Local Workforce Development Board under the Workforce Innovation and Opportunity Act of 2014 (WIOA, formerly the Workforce Investment Act, WIA); and adopt resolution to repeal Resolution 00-53 that created the Workforce Investment Act. Recommended Action
  1. Approve the Workforce Investment Board's application for the initial designation as the Local Workforce Development Area and certification of Local Workforce Development Board under the Workforce Innovation and Opportunity Act of 2014 (WIOA, formerly the Workforce Investment Act, WIA); and
     
  2. Adopt resolution to repeal Resolution 00-53 that created the Workforce Investment Act.

Reason for Recommended Action/Background
On July 22, 2014, President Barack Obama signed the Workforce Innovation and Opportunities Act (WIOA) into law. WIOA replaces the Workforce Investment Act (WIA) and is designed to help job seekers access employment, education, training and support services to succeed in the labor market and match employers with the skilled workers they need to compete in the global economy. Congress passed WIOA by a wide bipartisan majority and it is the first legislative reform of the public workforce system in 15 years. Most WIOA provisions related to Department of Labor (DOL) administrative programs take effect in Program Year (PY) 2015, which starts July 1, 2015.

In order to receive WIOA funding, initial local area designation and local board designation is needed during the WIA to WIOA transition years of July 1, 2015 through June 30, 2017. WIOA Section 106 states, the Governor shall approve a request made for initial designation by any local area if the area did the following during PY 2012-13 and 2013-14:
  1. Was designated as a local area under WIA
  2. Performed successfully
  3. Sustained fiscal integrity
The CWIB (State Board) and the Employment Development Department (EDD), acting under the authority of the Governor, have established policies and procedures for initial designation of local areas and the initial certification of local boards. Initial designation is effective July 1, 2015, through June 30, 2017. Local areas will be expected to develop new services, enter new collaborative partnerships, and/or create innovative workforce development strategies in alignment with WIOA during the initial designation period.
