Receive, file and approve the amended Conflict of Interest Codes submitted by the following local agencies and special districts (Attachment A):

Reason for Recommended Action/Background |
As required by the Political Reform Act (Government Code Section 87306.5) and Resolution 98-44, the Board of Supervisors, as the local conflict of interest code reviewing body, must provide notice to each local agency or special district in even-numbered years to review their conflict of interest code or exemption from the requirement to adopt a conflict of interest code. This notice was provided as required in July of 2014. As the notice explains, local agencies and special districts must then provide the Board of Supervisors with documentation regarding the status of their codes by October 1, 2014.
Under Government Code Section 87309, no conflict of interest code or amendment shall be approved by the Board if it (a) fails to provide reasonable assurance that all foreseeable potential conflict of interest situations will be disclosed or prevented; (b) fails to provide to each affected person a clear and specific statement of his duties under the Code; or (c) fails to adequately differentiate between designated employees with different powers and responsibilities.
On the basis of the information received from the referenced local agencies and special districts, the Office of the County Counsel believes that it is appropriate for the Board of Supervisors to receive, file, and where appropriate approve the documents received, included herewith as Attachments A-D. |
