Approve and authorize the Chair to sign First Amendment to Agreement with Cache Creek Lodge, Inc. to increase contract amount by $24,000 for the Adult Drug Court services for a new contract maximum amount of $117,450; and revise contract language where appropriate to clarify and refine the terms, conditions, and requirements of the Agreement accurately to provide Adult Drug Court or Indigent alcohol and drug treatment services to clients who are eligible for the period July 1, 2014 through June 30, 2017. Recommended Action

Reason for Recommended Action/Background
This Agreement provides funding for alcohol and drug treatment services for Adult Drug Court and Indigent clients. A recent projection indicates that additional funding will be needed for the Adult Drug Court portion of the Agreement. This increase will bring the funding more in line with the actual expenditures from fiscal year 2013-14, as well as taking into account the projection for the remainder of fiscal year 2014-15.

Since 1999 Adult Drug Court has been operating in Yolo County for non-violent felony offenders who were not eligible for PC 1000 drug court. The Yolo County Department of Health Services - Alcohol, Drug and Mental Health Department (ADMH) Division has served as that program's fiscal agent. Services for the Adult Drug Court clients are court ordered. The Yolo Superior Court refers eligible clients to the assigned drug court probation officer for assessment and suitability for Adult Drug Court.

Adult Drug Court is a comprehensive program with intensive supervision by the drug court assigned probation officer who serves as the primary case manager. ADMH and the Department of Probation have a Memorandum of Understanding (MOU) in place for Probation to provide a Drug Court Probation Officer for the intensive comprehensive supervision of Adult Drug Court clients.

Probation refers eligible Adult Drug Court clients to providers with whom ADMH has entered into contracts. ADMH ensures these providers are licensed and certified by the state Department of Health Care Services for alcohol and drug treatment services.

ADMH has entered into a contract with Cache Creek Lodge, Inc. for alcohol and drug treatment services for eligible Adult Drug Court clients. Approval of this Amendment will allow these court ordered services to continue without a disruption in services.

The original Agreement was approved by the Purchasing Manager. However as this Amendment increases the contract maximum by over twenty percent for fiscal year 2014-15 and makes the total amount of ADMH contracts with this vendor over $100,000 for fiscal year 2014-15 it requires Board of Supervisors approval.

Competitive Bid Process:
On July 31, 2007, the Board of Supervisors granted an approval to the Department of Alcohol, Drug, and Mental for certain exceptions to the contract procurement policy. Cache Creek Lodge, Inc. is an Adult Residential facility and according to this approval, is classified as "Any Willing Provider" and is exempt from the competitive bid process.

No county general funds are required by this action. The total increased amount for this Amendment is $24,000 for a new contract maximum amount of $117,450 for three fiscal years. The Probation Department receives this funding for the Adult Drug Court services and ADMH serves as the fiscal agent. The table below details the funding sources and annual amounts. The increase of $24,000 for fiscal year 2014-15 is included in the ADMH adopted budget for fiscal year 2014-15. ADMH will budget the funding necessary for fiscal years 2015-16 and 2016-17 accordingly in future budgets.
