Accept the work on the partial closure of Waste Management Unit 2 (WMU2) constructed by Nordic Industries, Inc. (Nordic) as complete, and authorize the Director of Planning and Public Works to sign and record the Notice of Completion and pay the final estimate releasing retention. (No general fund impact) (Bencomo/Whitman)
Recommended Action
  1. Accept the work on the final closure of Waste Management Unit 2 (WMU2) constructed by Nordic as complete.
     
  2. Authorize the Director of Planning and Public Works to sign and record the Notice of Completion and pay the final estimate releasing retention.

Reason for Recommended Action/Background
General standards for all waste management units require the owner of a landfill to close each landfill cell following completion of waste placement. Additionally, the landfill’s Waste Discharge Requirements, issued by the California Regional Water Quality Control Board, Central Valley Region (Water Board) required Waste Management Unit 2 (WMU 2) to be closed in 2012. Because of a decrease in waste disposal (due to the economic downturn and increased recycling efforts) only a portion of WMU 2 was completely filled and the County received a variance from the Water Board to close only a portion of WMU 2 in 2012.

On January 24, 2012, the Board of Supervisors approved the plans and specifications and authorized the Division of Integrated Waste Management (division) to advertise for bids for the final closure of WMU 2. On May 17, 2012, the division received five bids from general contractors. Nordic was the lowest responsible bidder, and on May 28, 2012, was awarded the construction contract.

Nordic started work on June 5, 2012, with 90 working days allowed in the agreement. The majority of the work was complete by November 4, 2012, but due to erosion damage caused by early rains in November of 2012, the project could not be deemed complete. Nordic was required to repair the damages following the wet weather season. The repairs were finished on April 30, 2013.

The Board of Supervisors’ acceptance of the work and authorization for the Director of Planning and Public Works to record the Notice of Completion will begin the 1 year construction warranty and allow staff to make the final payment to Nordic.
Other Agency Involvement
Division staff worked closely with staff from the Water Board to insure that construction met the design specifications.
