Reason for Recommended Action/Background
During normal operations, the Yolo County Central Landfill (Landfill) generates leachate and other liquid waste. The landfill also accepts other liquid wastes such as septage, chemical toilet wastes and industrial wastewater generated in unincorporated areas.  These liquid wastes are stored in the landfill's surface impoundments and disposed of by evaporation.  Historically, during years with unusually high rainfall, the volume of liquid waste has occasionally exceeded the evaporation capacity of the surface impoundments and required offsite disposal of some liquid waste.  Since 1991, the Landfill has discharged its excess leachate/stormwater to the adjacent Wastewater Treatment Plant (WWTP) operated by the City of Davis (City) for treatment and disposal.

The City's Sewers and Sewage Disposal Ordinance authorizes special contracts between the City and any industrial user, whereby the City may accept for treatment industrial waste at a charge fixed by special contract provided the waste does not violate any pretreatment standard.  The amount charged by the City pursuant to the special contract should reflect, as close as is reasonably practicable, the cost the City incurs in providing, operating, and maintaining the facilities serving the contracting industrial user. This agreement establishes a special industrial sewer rate for the City’s treatment and disposal of the Landfill’s wastewater at the WWTP.
Other Agency Involvement
County Landfill staff and City WWTP staff worked together to prepare the agreement. The agreement has been approved as to form by County Counsel and a resolution approving the special contract fees and authorizing the City’s Public Works Director to execute the agreement was approved by the Davis City Council on March 26, 2013.

Landfill staff estimates a $200,000 cost for the five-year term of the agreement, and has budgeted one-fifth of this amount, $40,000, for fiscal year 2014.  Sufficient funds will be budgeted in future years for liquid waste disposal. 

Under the agreement, the Landfill agrees to pay to the City a rate of $3.18 per 100 cubic foot of wastewater discharged by the County to the WWTP. The contracted rate is based upon 1) the City’s cost of operating and maintaining the WWTP, which comprises approximately 60% of the standard sewer rate for industrial discharges, and 2) the fact that the County does not use the City’s collection system to transport its leachate/stormwater to the WWTP.  Discharge volume is measured by existing meters as specified in the landfill's discharge permit.
